浅析法律修改及其规范化

【摘要】：法律修改是立法活动的表现之一。在社会经济快速发展的今天,社会关系不断地变化。法律为适应社会的变化,发挥其应有的调节和保障作用,也必须作出相应的调整,而这种调整往往是通过法律修改来实现的。近年来,中国法律的修改数量明显增加,然而,立法机关对法律修改的规范的不足和学界对于法律修法的理论基础研究的不重视,都直接或间接造成立法实践中法律修改失范现象十分普遍。这说明,我国法律修改属于立法中的薄弱环节。有鉴于此,本文立足于中国当前的立法实践,在辨析法律修改及其相关概念的基础上,对我国目前法律修改存在的实际问题进行了归类研究,并对其产生的原因一一进行剖析。最后,本文有针对性地分别就法律修改主体、法律修改程序、修改时间和修改技术存在的问题给出规范意见。
[Abstract]:Law revision is one of the manifestations of legislative activities. In the rapid development of social economy today, social relations are constantly changing. In order to adapt to the changes of society and play its due role of regulation and protection, the law must also make corresponding adjustments, and this adjustment is often realized through legal modification. In recent years, the number of legal amendments in China has increased significantly. However, the legislative organs have not paid enough attention to the norms of legal revision and the academic circles have paid little attention to the theoretical basis of the law revision. Both directly and indirectly cause the phenomenon of law modification to be out of order in legislative practice. This shows, our country law revision belongs to the weak link in the legislation. In view of this, based on the current legislative practice in China, based on the discrimination and analysis of the legal amendment and its related concepts, this paper classifies and studies the practical problems existing in the current legal revision of our country, and analyzes the causes one by one. Finally, this paper gives some suggestions on the subject, procedure, time and technology of law revision.
