论我国法治建设进程中人的和谐自由发展

【摘要】：人的发展问题是人类历史永恒的主题，人的发展不仅是哲学问题，更是实践问题。法治作为人类文明成果已经成为当今人类的重要生活方式，是人类发展的现实化途径，党的十五大将依法治国确定为我国的基本治国方略，社会主义法治建设在科学发展观的指导下彰显“以人为本”，推进并保障着人的发展。人是社会的产物，作为自由、独立个体的人在与他人的交往过程中存在和发展，每个人相互依存。人的发展是历史的、具体的，，在从“以物的依赖性为基础的人的独立性”迈向未来共产主义社会这一自由人联合体从而实现人的自由个性的进程中，人类选择法治作为其重要生活方式，法治以人为出发点与归宿，保障并促进人的自由个性的实现。我国现阶段正处于社会转型期，产生诸多矛盾与冲突的状况。和谐作为差异的和谐，是每个人自由发展的条件。在我国努力构建和谐社会的大背景下，我国法治建设进程中人的发展应当是和谐的自由发展，以和谐的自由为核心的社会主义法治保障、促进着人的和谐自由发展。同时人的和谐自由发展又要求立法完善、执法严格、司法公正、法律监督和建立法治文化，这是一个双向互动的历史进程。由于我国还处于社会主义初级阶段，市场经济不够健全导致市民社会的不成熟，又由于传统法治文化的消极影响与法治精神文化建设的薄弱导致在我国法治建设进程中公民主体性缺失、法律运行主体法律素质有待提高、人权法律保障不足、公民法治信仰缺失等问题，因此我们应建立“以人为本”的法治发展模式，健全法律制度，通过法律制度调整社会关系实现社会和谐稳定，建立健全人权保障制度与“三个机制”，从而为法治建设进程中人的和谐自由发展提供保障，同时应大力进行普法教育，培养公民法治信仰，使其维护自身和谐自由发展。
[Abstract]:Human development is an eternal theme in human history. Human development is not only a philosophical issue, but also a practical one. The rule of law, as a result of human civilization, has become an important way of life and a realistic way of human development. Under the guidance of the scientific concept of development, the construction of socialist rule of law shows "people-oriented" and promotes and guarantees the development of human beings. Man is the product of society, as a free, independent individual in the process of interaction with others exist and develop, everyone is interdependent. The development of human beings is historical and concrete, in the process of moving from "the independence of human beings based on material dependence" to the future communist society, a free association of people, thus realizing the free personality of human beings. Human beings choose the rule of law as their important way of life. The rule of law takes man as the starting point and destination to guarantee and promote the realization of human's free personality. At present, our country is in the social transition period, resulting in a lot of contradictions and conflicts. Harmony, as the harmony of difference, is the condition for everyone to develop freely. Under the background of our country's efforts to build a harmonious society, human development should be harmonious and free development in the process of building the rule of law in our country. The socialist legal guarantee with harmonious freedom as the core promotes the harmonious and free development of human beings. At the same time, the harmonious and free development of human beings requires the perfection of legislation, the strict enforcement of law, judicial justice, legal supervision and the establishment of a culture of rule of law, which is a two-way interactive historical process. As our country is still in the primary stage of socialism and the market economy is not sound enough, it leads to the immaturity of the civil society. Because of the negative influence of the traditional culture of rule of law and the weakness of the cultural construction of the spirit of rule of law, the citizen's subjectivity is absent, the legal quality of the subject of legal operation needs to be improved, and the legal protection of human rights is insufficient. Therefore, we should establish the "people-oriented" development model of the rule of law, improve the legal system, adjust social relations through the legal system to achieve social harmony and stability. The establishment and perfection of human rights guarantee system and "three mechanisms" can guarantee the harmonious and free development of human beings in the process of building the rule of law. At the same time, we should vigorously carry out law popularization education, cultivate citizens' belief in the rule of law, and enable them to maintain their own harmonious and free development.
