“法律谈判”课程建设及存在的问题

【摘要】:法律谈判的性质是"用证据来谈,用法律来判",课程教学目标是通过诊所式法律教育来培养学生从事法律谈判工作的职业能力和职业道德。教学内容可分为五个模块:法律应用基本技能培训、法律谈判理论研习、法律谈判成案教学、模拟法律谈判及法律谈判实践。本课程的教学在各校都处于探索阶段,应对教学过程中存在的师资队伍建设及教学质量提高等问题予以重视和合理解决。
[Abstract]:The nature of legal negotiation is "talk by evidence, judge by law". The goal of course teaching is to train students' professional ability and professional ethics to engage in legal negotiation through clinical law education. The teaching contents can be divided into five modules: training of basic skills in legal application, study of legal negotiation theory, teaching of legal negotiation case, simulation of legal negotiation and practice of legal negotiation. The teaching of this course is in the exploration stage in every school, so we should pay attention to and solve the problems existing in the course of teaching, such as the construction of the teaching staff and the improvement of the teaching quality.
