【摘要】：溯源现代公共借阅权思想之滥觞——德国公共借阅权制度的缘起和肇兴,阐析德国"版权"模式下的公共借阅权立法机理,解析其立法实践序程,解读德国与公共借阅权制度相关的政治架构安排,辨析该制度所涉及要点,分析数字创意及文化产业发展背景下德国公共借阅权制度的新进展与适应性变革,稽考德国公共借阅权制度对我国该领域相关立法实践的启示及借鉴价值。
[Abstract]:Tracing back to the origin of the thought of modern public borrowing right, the origin and development of German public borrowing right system, this paper expounds the legislative mechanism of public borrowing right under the mode of "copyright" in Germany, and analyzes the sequence of its legislative practice. This paper interprets the political framework arrangement related to the public borrowing right system in Germany, differentiates the main points involved in the system, and analyzes the new progress and adaptive change of the German public borrowing right system under the background of digital creativity and cultural industry development. The enlightenment and reference value of German public borrowing right system to the relevant legislative practice in this field.
