非会员著作权集体管理模式研究及中国的借鉴

【摘要】：北欧国家延伸集体管理模式和欧盟延伸强制集体管理模式,是著作权领域两种主要的非会员集体管理模式。我国《著作权法》第三次修订引入了北欧国家的延伸集体管理制度,该制度比欧盟延伸强制集体管理制度具有较大优越性,且与国际著作权法的《伯尔尼公约》、TRIPS协定相契合。文章指出,中国《著作权法》草案对该制度的借鉴具有必要性和可行性,但应在做出框架性规定的同时细化著作权集体管理条例。
[Abstract]:The extended collective management model in Nordic countries and the compulsory collective management mode in EU are two main non-member collective management modes in copyright field. The third revision of China's copyright Law introduces the extended collective management system of Nordic countries, which is superior to the extended compulsory collective management system of the European Union and is in line with the Berne Convention of International copyright Law. The TRIPS agreement is compatible. The article points out that the draft of China's copyright Law is necessary and feasible for the reference of this system, but it should be detailed in the regulation of collective administration of copyright.
