同治时期《申报》刊载法律资料研究

【摘要】：在19世纪以前的中国一直继承着古代传统法律体系,它是由于时代和地域等差异,而产生的有别于西方的法律体系。但是,这一传统在清末发生了变化,中国古代法律体系遭遇了瓦解的命运。造成这一结果的原因是多元化的,加之清末变法是中国法律史上重要的事件,它的影响力至今仍然存在,所以,全面、深入认识清末变法过程是中国法律史研究的一个重要课题。《申报》是我国发行最早的报纸之一,其从一八七二年四月三十日(清同治十一年三月二十三日)创刊,至一九四九年五月二十七日上海解放时停刊,约二万五千号。《申报》是了解中国近代史的第一手资料,其包含了丰富的资料内容,涵盖了社会、经济、法律、政治各个方面。在现阶段对清末的中国法律史研究成果中,时间段主要集中在1895年后,同治时期的研究较少。忽视每一个细节都会使我们对真实的变法过程的认识产生误读与偏差。由于时间、个人能力的限制,本文以同治时期《申报》中整理的法律资料为研究分析对象,尝试分析同治时期的相关法律制度、司法实践、西方法律文化对当时中国社会的影响、社会中民众法律观念的转变以及这些在整个变法过程的地位及作用。本文分为四部分,第一部分绪论,主要是介绍一下选题缘由,研究现状,主要内容、研究方法和创新;第二部分是对同治时期《申报》产生的历史背景及《申报》刊载的相关法律资料的具体内容做个简单的介绍;第三部分是对同治时期《申报》法律资料分析研究,尝试将同治时期《申报》法律资料所体现的当时相关司法实践层面的法律制度、西方法律文化的传播从法律史的视角分析;第四部分将同治时期《申报》法律资料分析的结果为依据,揭示同治时期,西方法律文化对当时社会影响及效果,并说明同治时期在清末变法中的地位及作用。
[Abstract]:Before the 19th century, China inherited the ancient traditional legal system, which was different from the western legal system because of the differences of times and regions. However, this tradition changed in the late Qing Dynasty, and the ancient Chinese legal system suffered the fate of disintegration. The reasons for this result are diverse. In addition, the reform of the late Qing Dynasty is an important event in the history of Chinese law. Its influence still exists today. A thorough understanding of the process of reform in the late Qing Dynasty is an important subject in the study of the history of Chinese law. Declaration is one of the earliest newspapers published in China, which was published on April 30, 1872 (on March 23, 2001). By May 27, 1949, when Shanghai was liberated, the publication was suspended, about 25,000. The Declaration is a first-hand information on China's modern history. It contains rich information, covering social, economic, legal, and political aspects. At the present stage, the research results of Chinese legal history in the late Qing Dynasty were mainly concentrated after 1895, and the study of Tongzhi period was less. Neglecting every detail makes us misread and deviate from the real process. Due to the limitation of time and individual ability, this paper tries to analyze the relevant legal system and judicial practice in the period of Tongzhi, taking the legal data collected in the same period of administration as the object of study and analysis. The influence of the western legal culture on the Chinese society, the change of the people's legal concept in the society and their status and function in the whole reform process. This article is divided into four parts, the first part of the introduction, mainly introduces the reason of the topic, research status, main content, research methods and innovation; The second part is to make a brief introduction to the historical background of the production of "declaration" and the specific contents of the relevant legal materials published in "declaration" during the period of Tongzhi. The third part is to analyze and study the legal data of the period of "declaration", and try to analyze the legal system of the relevant judicial practice level of that time and the dissemination of the western legal culture from the perspective of the history of law. In the fourth part, based on the analysis of the legal data in the period of Tongzhi, it reveals the influence and effect of the western legal culture on the society at that time, and explains the position and function of the period of Tongzhi in the late Qing Dynasty.
