唐代“敬老”法律制度透析

【摘要】：唐代是我国古代历史发展上的重要时期,中华民族敬老尊老的文化传统在彼时得到了极大的弘扬。自三代以降,沿袭从秦汉到魏晋各代在尊年尚齿方面的诸多优秀经验,唐代形成了自己独具特色而又行之有效的尊老敬老的法律制度。本文立足于唐代这一典型时期,对该时期的各项敬老尊老的措施进行深入挖掘,并着重探寻上述诸项措施的法规描述和制度保障,从整个国家法制规定的层面理解全社会对老年人权益的重视与维护,并总结出上述做法的进步意义与时代局限,进一步探讨这些经验与教训对于当今社会相关制度建设的指导意义和有益启示。本文全文约五万字,共分四章进行论述。第一章探寻中华民族“敬老尊老”传统的形成与发展;第二章是文章的重点,讨论唐代“敬老”法律的具体制度设计,分别从“身份尊崇、经济优待、家长特权、司法保护”四个方向共十几个方面,结合现在所能参考的历史文献和唐代律、令、格、式等法律文本的规定,具体介绍该时期的敬老尊老制度与举措;第三章从正反两个方面分析唐代“敬老”制度的合理价值与历史局限,探究这些制度规则形成的原因,分析其对于当时社会的进步意义同时指出其不足之处;第四章对唐代“敬老”法律制度的现代启示进行论述,总结唐代在相关方面的得失利弊,结合当代的时代背景,扬长避短,古为今用。
[Abstract]:The Tang Dynasty was an important period in the development of the ancient history of China, and the cultural tradition of respecting the elderly and respecting the elderly was greatly carried forward at that time. From the three generations down, the Tang Dynasty has formed its own unique and effective legal system of respecting the old and respecting the elderly, following many outstanding experiences of the dynasties from the Qin and Han dynasties to the Wei and Jin dynasties. Based on the typical period of the Tang Dynasty, this paper excavates deeply the measures of respecting and respecting the elderly in that period, and probes into the legal description and system guarantee of the above measures. Understanding the importance and protection of the rights and interests of the elderly in the whole society from the point of view of the legal provisions of the whole country, and summing up the progressive significance and time limitations of the above-mentioned practices, To further explore these experiences and lessons for the current social system construction guidance significance and beneficial enlightenment. This paper is about 50,000 words, divided into four chapters to discuss. The first chapter explores the formation and development of the tradition of respecting the elderly and respecting the elderly in the Chinese nation. The second chapter is the focus of the article, discussing the specific system design of "respecting the elderly" law in the Tang Dynasty, from the four directions of "status reverence, economic preferential treatment, parental privilege, judicial protection" in a total of more than a dozen aspects. Combined with the historical documents and the laws of the Tang Dynasty, Ling, GE, style and other legal texts, the system and measures of respecting the elderly and respecting the elderly in this period are introduced in detail. The third chapter analyzes the reasonable value and historical limitation of the "respect for the elderly" system in Tang Dynasty from the positive and negative aspects, probes into the reasons for the formation of these system rules, analyzes its progressive significance for the society at that time and points out its shortcomings. The fourth chapter discusses the modern enlightenment of the legal system of "respecting the elderly" in the Tang Dynasty, summarizes the pros and cons of the Tang Dynasty in relevant aspects, combines with the background of the contemporary times, promotes the advantages and disadvantages, and uses the past for the present.
