转型期农村民间互助法制化研究

【摘要】：互助行为在中国农村是极其常见的,它存在农村这一特定的文化土壤之中,是人们相互交往而产生的具有特定内涵和社会意义的行为。它无论是对构建中国农民生产、生活的保障体系,维系和密切村民的情感联系,达成基本的社会共识,还是对开拓法律本土化研究的新渠道,推进农村法治化建设,都具有极强的理论和现实意义。 中国传统意义上的农村互助合作并非商品经济基础上的专业化分工和社会化合作行为,而是建立在一种传统社会关系上的合作与互助,是建基于相互信任基础上的互帮互助行为,它所依循的行为规范是伦理性的,道德性的。随着市场经济的深入发展和人们需求层次不断提高,传统的礼治秩序逐渐解体,村民的生活空间不断扩展,以商品货币形式为表现,具有明确的权利和义务内容的新的契约互助逐步取代了道德互助,适应了时代的发展要求。 在社会转型时期,通过对农村民间互助类型的演变的调查分析,阐明了民间互助演变背后的社会环境和文化内涵。为了建立适宜农村社会的规范体系,切实保障农民的生产和生活,本文探讨和分析了农村民间互助法制化、制度化的必要性和可能的法制途径,以促进社会主义农村法制体系的完善。
[Abstract]:Mutual aid behavior is very common in China's rural areas. It exists in the specific cultural soil of rural areas and is a kind of behavior with specific connotation and social significance that people interact with each other. Whether it is to construct the guarantee system of Chinese farmers' production and life, to maintain and close the villagers' emotional ties, to reach a basic social consensus, or to open up new channels for the study of localization of law, and to promote the construction of rural legalization. Both have strong theoretical and practical significance. The rural mutual assistance and cooperation in the traditional sense of China is not the specialized division of labor and socialized cooperative behavior on the basis of commodity economy, but the cooperation and mutual assistance based on a traditional social relationship. It is based on mutual trust and mutual help behavior. With the further development of market economy and the continuous improvement of the level of people's needs, the traditional order of rule of etiquette has gradually disintegrated, and the living space of villagers has been continuously expanded, which is manifested in the form of commodity money. The new contractual mutual aid with clear rights and obligations gradually replaces moral mutual aid and adapts to the development requirements of the times. In the period of social transformation, the social environment and cultural connotations behind the evolution of rural mutual assistance are clarified through the investigation and analysis of the evolution of rural folk mutual assistance. In order to establish a standard system suitable for the rural society and ensure the farmers' production and life, this paper discusses and analyzes the necessity and possible legal approach of the legalization and institutionalization of rural folk mutual assistance. In order to promote the improvement of socialist rural legal system.
