南非《投资促进与保护法案》评析

【摘要】：南非在废除种族隔离政策后的一段短时期内,为了吸引外资,重返国际社会,与一些国家特别是欧洲国家签署了双边投资保护协定。由于这些双边协定更多强调的是投资者的权利,而不太关注东道国为公共利益目的对经济进行监管的权利,因此,这些协定有的成为南非日后实施《黑人经济振兴法》的潜在障碍。在对这些双边投资保护协定进行审查后,南非政府决定终止同一些欧洲国家签订的双边投资保护协定,并决定制定一部新的投资法来对南非境内的所有投资进行规范。南非《投资促进与保护法案》就是在此背景下出台的,该法案的内容对南非此前签署的双边投资保护协定的内容作了较大调整。法案的出台意味着南非投资法律、政策将有重大转变。而这一转变已引起一些国家特别是欧洲国家的关注。南非作为中国在非洲的最大投资目的地,中国方面也应关注该法案的内容,并及时做出应对。
[Abstract]:In the short period after the abolition of apartheid South Africa signed bilateral investment protection agreements with some countries especially European countries in order to attract foreign capital and return to the international community. Since these bilateral agreements place more emphasis on the rights of investors than on the right of host countries to regulate the economy for public interest, Some of these agreements have become potential obstacles to the future implementation of the Black Economic recovery Act in South Africa. After reviewing these bilateral investment protection agreements, the South African government decided to terminate the bilateral investment protection agreements with some European countries and to formulate a new investment law to regulate all investments in South Africa. The South African Investment Promotion and Protection Act (IPA) was introduced against this background, and the content of the Act makes a great adjustment to the content of the bilateral Investment Protection Agreement previously signed by South Africa. The introduction of the bill means a major change in South African investment law and policy. This shift has attracted the attention of some countries, especially in Europe. South Africa, China's biggest destination for Chinese investment in Africa, should also pay attention to the bill and respond in a timely manner.
