秦汉时代律令的传播

【摘要】：秦汉时代,君权乃一切权力之根源,律令作为皇帝意志的制度化表达也具备了统一臣民之言行的强大功能。为了贯彻律令之治,秦汉朝廷致力于向吏民传播律令以使他们知晓律令的规定。在官府内部,对律令的摘抄和对富含律令术语的习字教材的编纂在一定程度上满足了官吏们了解律令知识的需求。在民间,庶民也或主动或被动地获取了律令知识,而传世及出土文献所载"以吏为师"、"扁书"、"诵读"等正是对这一过程的揭示。当然,对律令传播的重视并非秦汉朝廷的创造,而是对先秦时代的法规范重构运动之结果的继承和改进。
[Abstract]:In Qin and Han dynasties, monarchy was the root of all powers. As an institutionalized expression of the emperor's will, the law and order also had the powerful function of unifying the words and deeds of the subjects. In order to carry out the rule of the law, the Qin and Han dynasties tried to disseminate the law to the officials so that they could know its provisions. Within the government, the excerpt of the laws and decrees and the compilation of the teaching materials rich in the terms of the laws and decrees satisfy the needs of the officials to understand the knowledge of the laws and decrees to a certain extent. In the folk, the common people have acquired the knowledge of the law and order actively or passively, and this process is revealed by the documents published in the world and unearthed, such as "taking officials as teachers", "flat books", "reading" and so on. Of course, the emphasis on the dissemination of laws and decrees is not the creation of the court in Qin and Han dynasties, but the inheritance and improvement of the result of the reconstruction of laws and regulations in the pre-Qin period.
