西汉扬雄《廷尉箴》的主旨与贡献——法官箴言研究之二

【摘要】：西汉扬雄《廷尉箴》是历史上第一个法官箴,它从法官职守角度提出君主应秉持的刑政理念、政策纲要,所谓"说人君谨刑罚";它叙列尧舜禹三王、夏商周三代及秦国(朝)的法制历史,宣扬儒家情操,贬抑法家-秦国(朝)治术。《廷尉箴》从儒家立场总结历史经验,指斥"寇贼满山,刑者半道"的重刑虐民现象,警告君主不要以为"惟虐惟杀,人莫予奈",最终得出"殷以刑颠,秦以酷败"的发人深省的结论。《廷尉箴》是儒家刑政观的"箴言"形态,本质上是一种文学表达;箴的这种旨趣,在诔、诗等其他文体中有相同的表现。扬雄《廷尉箴》开风气之先,对东汉唐宋元等后世法官箴的创作影响颇大。
[Abstract]:Yang Xiong in the West Han Dynasty is the first judge pro in history. From the point of view of judge's duty, it puts forward that the monarch should adhere to the concept of criminal administration, policy outline, so-called "saying that man is king to punish"; It narrates the legal history of Yao, Shun-Yu, Xia, Shang and Zhou dynasties and Qin (Korea), preaches Confucian sentiment, detracts the legalist-Qin State (Korea), sums up historical experience from the Confucian standpoint, and denounces "invaders and thieves all over the mountains." The phenomenon of torturing the people in the middle of the sentence warns the monarch not to think that "only torture only kills, man does not give way to nai," and finally comes to a thought-provoking conclusion that "Yin goes to the top of punishment, and Qin is utterly defeated." < Proverbs by Warrant officers > is the "motto" form of the Confucian view of criminal and political affairs. In essence, it is a kind of literary expression; This purport of proverbs has the same expression in other styles, such as eulogy, poetry and so on. Yang Xiong had a great influence on the creation of justice pro in the Eastern Han Dynasty, Tang, Song and Yuan dynasties.
