法律与音乐视域下的原意论批判

【摘要】:法律与音乐作为一项法学跨学科研究是建立在法律和音乐的关联性基础上的,其具有鲜明的理论特点与独特的理论优势。法律和音乐领域共同关注文本的解释实践活动。法律与音乐确立了"作曲家—作品—演奏家—听众"的理论框架,对原初意图论、文本原意论等提出了反思与批判,合力推进了对原意论的理论认识深度。法律与音乐视角下的原意论研究为该理论的更新与超越提供了一种新的可能,促使法律和音乐实践活动中权力关系的重新定位,消除单一要素的绝对控制,朝更具开放性、复杂性与解释力的方向发展。同时,法律与音乐为理解原意论的生成与发展的总体历史脉络提供了一种新思路。法律与音乐研究可使两个领域的学科相互参照,彼此联系,达成理论资源与成果的共享,对推进国内的法学跨学科研究发展具有积极意义。
[Abstract]:As an interdisciplinary study of law and music, law and music are based on the relevance of law and music, with distinct theoretical characteristics and unique theoretical advantages. The field of law and music pays close attention to the practice of text interpretation. The law and music have established the theoretical frame of "composer-work-performer-listener", have put forward the reflection and criticism to the original intention graph theory, the text original idea theory and so on, have promoted the theoretical understanding depth of the original meaning theory together. The study of the original theory from the perspective of law and music provides a new possibility for the renewal and transcendence of the theory, promotes the re-positioning of the power relationship in the practice of law and music, eliminates the absolute control of a single element, and becomes more open to the future. The development of complexity and explanatory power. At the same time, law and music provide a new train of thought for understanding the overall historical context of the formation and development of idealism. The study of law and music can make the subjects of the two fields cross-reference, connect with each other, and achieve the sharing of theoretical resources and achievements.
