河南传统衙署法律文化引论

【摘要】：传统衙署和现代法律文化能够产生交集,源于中国历史上长期以来深刻的政治文化传统,即刑名司法是地方行政的应有之义,由此赋予地方各级主官及其衙署多种复合法律功能,几乎涵括了当代中国司法系统中公安局、法院、检察院以及司法局的职能,并充分体现在衙署建筑中。河南衙署建筑蕴含了中国传统司法之亲民、教化和息讼的三大基本价值追求,衙署建筑体现出中国古代社会礼制传统,如面南背北、居中而治、前朝后寝、左文右武等。
[Abstract]:The intersection of traditional government offices and modern legal culture stems from the long-standing political and cultural tradition in Chinese history, that is, the judicature of criminal names is the proper meaning of local administration. As a result, local officials at all levels and their government offices are endowed with various complex legal functions, which almost include the functions of the public security bureau, the court, the procuratorate and the judicial bureau in the contemporary Chinese judicial system, and are fully embodied in the Nga building. Henan Yacheng architecture contains three basic values of Chinese traditional justice, namely, pro-people, education and settlement of litigation. It embodies the tradition of etiquette in ancient Chinese society, such as facing south and north, ruling in the middle and ruling in the middle, lying in the back of the former dynasty, writing right and left in the left and right martial arts, and so on.
