马克思主义法学的十大原理——马克思主义法学探索之二

【摘要】：马克思主义法学基本原理,支撑其学科形成。按照制度本性与基础性标准,经济决定法律、国家掌控法律、法律的阶级性、法律的适度反决定、法律的历史性、基于私有制的违法必然、革命超越法律、资本主义法治的虚伪性、社会主义法治的历史必然和法律的东方道路,构成马克思主义法学的十大基本原理。这十大原理,支撑马克思主义法学的形成,催生明确的社会主义法学意识,推动社会主义法治的最终建成。
[Abstract]:The basic principles of Marxist law support the formation of its disciplines. According to the nature and basic standards of the system, the economy determines the law, the state controls the law, the class nature of the law, the moderate inverse decision of the law, the history of the law, the necessity of violating the law based on private ownership, the revolution surpassing the law, the hypocrisy of the capitalist rule of law, the historical necessity of the socialist rule of law and the oriental road of the law, which constitute the ten basic principles of Marxist law. These ten principles support the formation of Marxist law, give birth to clear socialist legal consciousness, and promote the final completion of socialist rule of law.
