语义学方法与法律词汇学习

法律专业的学生不仅要学习大量的案例,法规和法理,还必须学习法律语言。而在法律语言中,各种行话、习语、古语、外来词比比皆是,即使对于法律承载语为本族语的学习者来讲,法律语言都堪称为一门外语,而对于以第二语言为媒介来学习法律的学习者来讲更是晦涩难懂,无怪乎学习者在学习过程中大多面临着巨大的困难。为了帮助法律英语的学习者在一定程度上克服这一困难,掌握一定的学习者策略,本文拟通过对语义学方法的一些介绍,提供一种学习法律英语的有效途径,即语义学的途径。 本文分为五个章节。第一章主要阐述了法律和语言的关系,指出语言对于法律的关键性作用。此外,本章就国内外学界对语言和法律关系的研究进行了一个简要的综述,简要介绍了部分影响较大的学者和其著作,并指出了其很少涉及本文论题,即把与图示法相结合的语义学方法作为一种法律学习者策略,从而论述了本文写作的实际意义。 第二章回顾了本文将要应用的语义学理论的研究状况,它首先概述了语义成分分析法,并对该语义学方法的研究历史进行了介绍,同时还通过实例解释了该方法的具体内容。本文接着介绍了语义场理论的发展史,特别谈到了语义场理论的先行者特里尔和他提出的几个原则和该理论的优缺点。接下来的部分主要讨论了语义关系以其分类,提到了三种基本关系类别:近义,反义和上下义。第四部分讨论了语义场的五大特征,即层级性,交叉性,相对性,可变性和民族性。本章最后一部分提及到了图示法对词汇学习的助益,主张把图示法和语义学理论结合起来运用到词汇学习中去。 第三章着重介绍了学习策略理论,列举了部分学界对学习者策略研究历史和现状,学习者策略的定义,讨论了该理论的特点,和其对实践的指导作用,提出教授者应该向学习者传授学习策略以达到事半功倍的效果。 第四章主要讨论了如何通过上述语义学理论和方法来确定法律词汇词义和扩大法律词汇量。本章首先区别了同义词的普通意义和法律意义,接着介绍了如何用成分分析法来区分法律词汇中的近义词和反义词,指出法律学习者可以通过分析近义词组和反义词组的语义成分来深入理解法律条文的精髓。本章还建议适用语义场作为法律词汇积累的手段。本章的最后部分结合科恩的策略教学五步法提出了进行法律词汇教学的方法,并设计了部分练习。 第五章得出结论,语义学方法是一种有效的学习策略,能在一定程度上辅助学习者对法律词汇的学习。同时提出了值得进一步研究的一些问题。
