论污点证人制度在我国的建构

【摘要】：污点证人豁免,是指在部分重大的犯罪案件中，国家司法机关为了发动涉案污点证人提供重要案件证据，给予作证的有关污点证人承诺，司法机关不能在其作证后追究其刑事责任或者不得以其所提供的证据为依据用来追究其刑事责任。污点证人不自证其罪的证言特免权在我国不但属于立法上的空白，而且在理论上也未有深入的研究，甚至很多学者仍未将它从被告人不自证其罪证言特免权中区分出来。近年来，随着对国外污点证人豁免制度了解的逐渐深入，我国理论界也对于该问题表现出了强烈的兴趣，针对污点证人豁免的相关问题的讨论已经逐渐成熟。我们支持污点证人不自证其罪证言特免权在我国法律中应有的地位，并将之视为保障污点证人权利的一个方面。污点证人豁免制度主要是给予犯罪较轻的罪犯承诺，以换取重要案件的关键证据，从而使重大案件的主要犯罪分子受到刑罚处罚，而不追究较轻犯罪分子的刑事责任。本文研究了国内外污点证人豁免制度的立法基础，结合我国实际国情，，认为在我国现行的法律框架下，建立人民法院污点证人豁免制度，人民法院对污点证人的豁免有批准权，应该采用证据使用豁免制度，从而构建我国污点证人豁免制度。
[Abstract]:The exemption of tainted witness means that in part of the major crime cases, the state judicial organ in order to mobilize the tainted witness involved in the case to provide important evidence, to give evidence of the relevant tainted witness promise to testify. The judicial organ cannot investigate its criminal responsibility after it testifies or may not use the evidence provided by it as the basis for its criminal responsibility. The power of special immunity of a stain witness not to testify against himself is not only a legislative void in our country. White. And in theory there is no in-depth study, and even many scholars still haven't distinguished it from the right of the accused not to testify against himself. In recent years, with the gradual deepening of the understanding of the system of exemption of foreign tainted witnesses. China's theoretical community has also shown a strong interest in this issue. The discussion on the immunity of tainted witnesses has matured gradually. We support the status of the special exemption right of stain witnesses not to testify on their own in our law. It is regarded as an aspect of safeguarding the rights of tainted witnesses. The system of immunity of tainted witnesses is mainly to give a promise to minor offenders in exchange for key evidence in important cases. So that the major criminals in major cases will be punished by punishment, but not the criminal liability of minor criminals. This paper studies the legislative basis of the exemption system of stain witnesses at home and abroad, combined with the actual situation of our country. It is believed that under the current legal framework of our country, the people's court should establish the exemption system of the tainted witness in the people's court, and the people's court has the right to approve the exemption of the tainted witness, and should adopt the exemption system of using evidence. In order to construct our country tainted witness exemption system.
