论司法的确定性

【摘要】：司法确定性是个古老而又长期以来一直存在争议的话题,不同时期、不同学派,对司法确定性产生过不同的观点和看法。自有司法活动以来,司法确定性就是人们在法律活动中追求的基本目标之一。不同时代的人们从未放弃对司法确定性的追求。全文共分六个部分,即引言和结尾以及四章论文的主体部分:在绪论部分,笔者交代了选择司法确定性问题的原因,并顺便交代了全文的论证结构,对绪论以外的其它各部分内容做了简要概括。第一章通过探究确定性的法哲学含义,来进一步界定司法确定性的内涵。第二章阐述司法具有确定性的原因,并探讨影响司法确定性的各种因素。在这一章笔者还分析了司法确定性的价值及其表现。第三章围绕不同历史时期各学派对司法确定性的争论,阐述这一问题的历史发展过程。第四章在立足前文的基础上,结合我国司法实际,提出在当前我国实现司法确定性的构想。在论文的结尾提出在当代中国实现司法的确定性要走一条综合的道路。
[Abstract]:Judicial certainty is an old and controversial topic for a long time. Different schools of thought have different views on judicial certainty in different periods. Judicial certainty is one of the basic goals that people pursue in legal activities, and people in different times never give up the pursuit of judicial certainty. The full text is divided into six parts, that is, the introduction and the end, and the main part of the four chapters. In the introduction, the author explains the reasons for the choice of judicial certainty, and incidentally explains the argumentation structure of the full text. The first chapter further defines the connotation of judicial certainty by exploring the legal philosophy meaning of certainty. The second chapter expounds the reasons of judicial certainty. In this chapter, the author also analyzes the value and performance of judicial certainty. This paper expounds the historical development of this problem. Chapter 4th, on the basis of the above, combines the judicial practice of our country. At the end of this paper, the author points out that it is necessary to take a comprehensive road to realize judicial certainty in contemporary China.
