【摘要】：在现今的刑事司法刑罚执行领域，社区矫正凭借着自身非监禁性和全社会性的特点，受到了世界各国的推崇。它有选择性的将一些犯罪情节较轻、社会危害程度较小、悔罪意图及悔罪表现明确的罪犯，整合社会资源及力量，对其进行针对性的改造、教育。各国实践证明，社区矫正这种非监禁式的刑罚执行模式更有利于罪犯接受教育和改造后回归社会，，有效降低重新犯罪的比例。我国采取的是以点带面的方式来逐步推行社区矫正制度。《刑法修正案（八）》和即将实施的新《刑事诉讼法》，均将社区矫正制度写入条文，给予了社区矫正工作相应的法律地位，这也标志着社区矫正制度已经在我国全面实行。但是，从我国定点试行社区矫正工作到现在的十年时间里，我们在看到社区矫正制度日益显现的优点、带给我们惊喜的同时，也应清醒地看到一些缺点也在日渐暴露。而检察机关作为我国法律规定的监督机关，如何发挥法律监督职责，构建有效的监督模式、使用有效的监督手段，防止或减少社区矫正制度缺点的暴露，为社区矫正在实践中体现自身固有价值保驾护航，这将是检察机关在新形势下面临的重大课题。对于社区矫正检察监督问题，理论界和实务界都给予了普遍的重视和关注。本文旨在通过考察我国现行社区矫正检察监督工作实况，发现检察机关在行使社区矫正检察监督职能时存在的不足。并在分析这些不足的基础上，找到检察机关未能有效行使社区矫正检察监督职能的内在原因和外在的制约因素。由此，针对开展社区矫正检察监督工作的问题和阻碍，对社区矫正检察监督工作存在的立法滞后、管理体制不畅、权能狭隘等问题提出对策及建议。
[Abstract]:In the field of criminal justice and punishment enforcement nowadays, community correction is praised by the countries all over the world by virtue of its own characteristics of non-imprisonment and the whole society. It selectively makes some crimes lighter and the degree of social harm is small. Criminals who have clearly expressed their repentance intention and repentance, integrate social resources and forces, and carry out targeted reforms and education. The practice of various countries has proved that, Community correction is more favorable for criminals to receive education and return to society and reduce the proportion of reoffending effectively. In our country, the community correction system has been gradually implemented in a point-to-face way. The "Criminal Law Amendment (8)" and the new "Criminal procedure Law", which will soon be implemented, have written the community correction system into the provisions. Has given the corresponding legal status to the community correction work, which also marks that the community correction system has been fully implemented in our country. However, in the ten years since the designated trial of community correction work in our country, While we see the growing advantages of the community correction system and surprise us, we should also soberly see that some shortcomings are also being exposed day by day. And how should the procuratorial organs, as the supervisory organs prescribed by the laws of our country, give play to their legal supervisory duties? Construct effective supervision mode, use effective supervision means to prevent or reduce the exposure of shortcomings of community correction system, and protect community correction from reflecting its inherent value in practice. This will be a major task facing the procuratorial organs under the new situation. The theoretical and practical circles have paid much attention to the procuratorial supervision of community correction. The purpose of this paper is to investigate the current situation of the procuratorial supervision of community correction in China. Found that the procuratorial organs in the exercise of the function of community correction of procuratorial supervision deficiencies. And on the basis of analysis of these deficiencies, To find out the internal reasons and external restrictive factors for the procuratorial supervision function of community correction that the procuratorial organ failed to exercise effectively. Therefore, in view of the problems and obstacles in carrying out the procuratorial supervision work of community correction, This paper puts forward some countermeasures and suggestions on the problems of legislation lag, management system unobstructed and narrow power in the procuratorial supervision of community correction.
