法检两院的宪法定位与司法改革

【摘要】：中国的司法改革是一场重大的政治革命,是建设社会主义法治国家的关键步骤。其任务是:通过司法改革实现司法公正,以司法公正引领社会公正并促进法治社会建设;通过完善司法管理体制和司法权力运行机制,实现司法权力与其他国家权力的合理配置,健全各种权力行使的法律制度并形成相互制约关系,有效防治权力腐败以促进法治政府建设。不能将司法改革视为司法机关"系统内部"的改革,也不能将其理解为"司法技术"的改革,更不能将其简单地看成是司法权力再分配的改革。司法改革要卓有成效地进行,应首先依据宪法落实法检两院的宪法定位,而这也是构建"以审判为中心的诉讼制度"的宪政前提。
[Abstract]:China's judicial reform is a major political revolution and a key step in building a socialist country ruled by law. Its tasks are: to realize judicial justice through judicial reform, to guide social justice by judicial justice and to promote the construction of a society ruled by law; Through perfecting the judicial management system and the judicial power operation mechanism, realizing the rational disposition of the judicial power and the power of other countries, perfecting the legal system of the exercise of various kinds of power and forming the mutual restriction relation, The effective prevention and control of power corruption in order to promote the construction of a government ruled by law... judicial reform cannot be regarded as a reform within the "system" of the judiciary, nor can it be understood as a reform of "judicial technology". Nor can we simply regard it as a reform of the redistribution of judicial power. In order to carry out judicial reform effectively, we should first implement the constitutional orientation of both chambers according to the Constitution. This is also the constitutionalism premise of constructing trial-centered litigation system.
