论媒体监督对刑事审判的影响及其规制

【摘要】：随着信息时代的到来,越来越多的传媒形式不断涌现,媒体对于传递信息、丰富大众的精神世界有着十分重要的作用。然而,媒体不仅担负着信息传播的功能,还有着更为重要的社会功能,那就是监督功能。媒体的监督功能在西方社会被视为仅次于行政、司法、立法之外的“第四权力”。特别是近年来,互联网的不断发展,社会的传媒形式更是出现了天翻地覆的变化。司法领域作为我国政治生活的重要组成部分,更是各类媒体监督的重点。刑事审判是司法领域的关键一环,由于其涉及到对于个人生命权利和人身自由权利的裁定,所以这也成为了社会集中关注的焦点,因此媒体对此也是有着极为强烈的监督态势。审判活动是司法活动的重要环节,也是决定司法公信力和权威性的重要力量。刑事审判又是审判活动的重要内容之一,由于刑事审判涉及到的多为公民的人身权益和财产权益,这对于每个公民来说都是极为重要的,特别是对于生命权的审判,更是成为了社会聚焦的环节。刑事审判其根本上是为了惩治犯罪,保障人权,然而如何实现这一目的主要集中体现在审判权是否独立,审判过程是否公开。目前我国存在着部分媒体对于案件事实的扭曲报道和具有偏激的主观倾向,这也在一定程度上煽动了社会舆论,造成了刑事审判的压力,甚至会影响司法判决。本文试图通过论证分析媒体监督与刑事审判的关系,并且结合国外的相关立法来实现我国对于媒体监督的合理规制,使媒体监督的方式更适合我国的国情。通过规范媒体监督,更好的实现十八届四中全会提出的依法治国的理念。
[Abstract]:With the arrival of the information age, more and more media forms are emerging. The media plays a very important role in transmitting information and enriching the spiritual world of the masses. However, the media is not only responsible for the function of information dissemination, There is also a more important social function, that is, the function of supervision. The supervisory function of the media is regarded as "4th powers" in Western society after the administration, the judiciary, and the legislature. Especially in recent years, the Internet has been developing continuously. The forms of social media have changed dramatically. As an important part of our country's political life, the judicial field is also the focus of all kinds of media supervision. Criminal trial is a key link in the judicial field. Because it involves the adjudication of the right to personal life and the right to personal liberty, it has also become the focus of attention of the society. Therefore, the media also has a very strong situation of supervision over it. Judicial activities are an important link in judicial activities. It is also an important force that determines the credibility and authority of the judiciary. Criminal trial is also one of the important contents of judicial activities. Because most of the criminal trials involve the personal and property rights and interests of citizens, This is extremely important for every citizen, especially the trial of the right to life, which has become the focus of society. The fundamental purpose of criminal trial is to punish crime and protect human rights. However, how to achieve this goal is mainly reflected in whether the judicial power is independent and whether the trial process is open. At present, there are some distorted reports and extreme subjective tendencies of the media on the facts of the case in our country. This, to a certain extent, incites public opinion, creates pressure on the criminal trial, and even affects the judicial decision. This paper attempts to analyze the relationship between media supervision and the criminal trial through demonstration and analysis. And combine the relevant legislation of foreign countries to realize the reasonable regulation of media supervision in our country, make the way of media supervision more suitable for the national conditions of our country. Through standardizing the media supervision, we can better realize the idea of governing the country according to law put forward by the fourth Plenary session of the 18 CPC Central Committee.
