理性博弈:基层社会维权策略与过程的新解释——基于某市一次交通事故维权案例的分析与透视

【摘要】：本文以一个交通事故维权的案例为基础,以内部视角深描维权策略与演进过程。维权者必须掌握理性维权的"艺术"。在气与理性、道德与法律两种张力下,维权者根据具体情势的变化,不断升级维权策略和手段,做到有理、有力、有据。注意把控这些因素互相转化的时机和分寸,在取得现实性正义之后,及时退场,否则,形成逼迫机制,导致博弈双方行为的升级,伦理诉求压倒理性考量,维权行为由温和走向极端,维权性质演变为政治行动。
[Abstract]:Based on a case of traffic accident, this paper describes the strategy and evolution of protecting rights from an internal perspective. Defenders must master the "art" of rational rights protection. Under the tension of qi and rationality, morality and law, According to the changes in the specific situation, defenders constantly upgrade their strategies and means to safeguard their rights, so that they can be rational, powerful, and have evidence. Attention should be paid to the timing and discretion of controlling these factors to transform each other, and after obtaining realistic justice, they will leave the scene in a timely manner, otherwise, The formation of coercion mechanism leads to the escalation of the behavior of both sides of the game, the ethical demands overwhelm the rational consideration, the rights safeguarding behavior changes from moderate to extreme, and the nature of safeguarding rights evolves into political action.
