G市民事检察建议实证研究

【摘要】：我国民事检察建议是在民事检察实践中产生和发展起来的,其在提高办案效率、协调公正与效率、柔化法院与检察院的关系等方面发挥了积极的作用。然而,由于立法的不完善,民事检察建议在我国检察实践中的运行较为混乱,这无疑将影响司法的权威。对此,2012年最新修改后的《中华人民共和国民事诉讼法》正式将民事检察监督写入了法律,2013年最高人民检察院相继公布并实施了《人民检察院民事诉讼监督规则(试行)》,对再审检察建议的适用范围及适用程序作了细化的规定,进一步把再审检察建议与抗诉在适用范围上区别开来,并对程序监督检察建议、执行监督检察建议以及改进工作检察建议的适用加以规定。为了更好地反映民事检察监督的施行状况,本文收集了G市各区县检察机关在民诉法修改前后的民事检察建议制发数据,将实践工作中民事检察建议适用过程中产生的种类进行分类统计,并通过走访G市各区县检察机关的民行科室了解到民事检察建议适用过程中存在的诸多问题。本文共分为三个部分,第一部分对调研结果进行阐述,对G市民事检察建议的适用情况以及各类检察建议的适用范围进行列明,并收集了G市民事检察建议2011--2014年的总体制发情况以及2014年各基层检察院具体制发情况,并分别用图表展示出来;第二个部分从实地调研数据出发,围绕调研过程中发现的民事检察建议实际适用中的问题,进一步分析G市各区县检察机关适用民事检察建议所面临问题的原因;第三部分在分析民事检察建议所存在的立法及实践问题的基础上,为完善检察建议制度提出了解决思路与对策。
[Abstract]:The civil procuratorial suggestion of our country is produced and developed in the civil procuratorial practice. It has played an active role in improving the efficiency of handling cases, coordinating justice and efficiency, and softening the relationship between the court and the procuratorate. Due to the imperfection of legislation, the operation of civil procuratorial suggestions in our country's procuratorial practice is rather chaotic. This will undoubtedly affect the authority of the judiciary. In this regard, the newly revised Civil procedure Law of the people's Republic of China in 2012 formally incorporated civil procuratorial supervision into the law. In 2013, the Supreme people's Procuratorate promulgated and implemented the "people's Procuratorate". Rules for Supervision of Civil Proceedings of the Procuratorate (for trial implementation) > the scope of application and the applicable procedure of the procuratorial proposal for retrial are specified. Further differentiating the scope of application between the procuratorial proposal for retrial and the protest, and supervising the procuratorial proposal for procedural supervision, The implementation of supervisory and prosecutorial recommendations and the improvement of the application of procuratorial recommendations are to be stipulated. In order to better reflect the implementation of civil procuratorial supervision, This paper collects the data of the civil procuratorial suggestion system before and after the revision of the civil litigation law in the procuratorial organs of each district and county of G city, and classifies the kinds of civil procuratorial suggestions produced in the process of application of the civil procuratorial suggestions in practice. And through visiting the civil industry department of procuratorial organs in all districts and counties of G city, we can find out many problems existing in the process of application of civil procuratorial suggestions. This paper is divided into three parts, the first part is to expound the results of the investigation. The application of civil procuratorial proposals in G city and the scope of application of various procuratorial suggestions are listed, and the general system and distribution of civil procuratorial proposals in G city from 2011 to 2014 are collected, as well as the specific situation of various grass-roots procuratorates in 2014. The second part is based on the field investigation data, and focuses on the problems in the practical application of the civil procuratorial recommendations found in the course of investigation. Further analysis of the reasons for the problems faced by procuratorial organs in all districts and counties of G city in applying the civil procuratorial suggestions. The third part is based on the analysis of the legislative and practical problems existing in the civil procuratorial proposals. In order to perfect the procuratorial suggestion system, the author puts forward the solution thought and countermeasure.
