律师协会在越南立法工作中的地位与作用研究

【摘要】：根据于1955年4月4日130/NV/DC/ND号法令越南律师协会于1955年成立。律师协会在越南共产党和越南社会主义共和国国家管理的领导。是一个政治-社会-职业组织,国家各律师的自愿统一组织,是越南祖国阵线的成员。协会的运作目的原则与建设越南社会主义法权国家事业密切连接。在越南目前的改革进程,关于改革政治体制,建设社会主义法权国家,加强国际一体化事宜需要政治的整个体系的许多努力,其中有越南律师协会。有意义的战略目标之一是在参加建立法律政策工作中发挥越南律师协会的作用是值得的律师组织工作领域的建设,实施和保护措施的性质法律。目前,越南律师协会正面临着新的机遇和新挑战。近年来在越南的立法工作已经有许多重大的进展。建设法律进程更加民主执行；法律文本的质量更加提高。各政治和社会组织,公民个人已经有许多机会和条件以对建设法律参加意见。与目前该国的发展,法律的作用和社会体制如律师协会政治注意过程中。党和国家的许多文件已强调,越南律师协会的重要作用。事实上,许多立法活动,教育和法制宣传,法律援助党和国家已分配给越南律师协会。在政治系统中律师协会的地位正在发展。在研究和评估越南国家立法进程现状的基础上并越南律师协会的参加在过去时间已经参加于建立法律进程,论文主要集中研究一下主要问题：研究建设现行法律进程；参加参加建立越南律师协会法律和各法律的专门机构现状。从此,评估关于立法进程的有效作用和存在问题现行法律规定的缺点现状；在立法过程中。评估越南律师协会的客观性作用和有效地位。建议机制让律师协会有效参与立法过程。具体建议,建议完善有关法律,概述法治社会的基本内容和参加建立法律。在参与立法进程的各个阶段过程中综合和分析以澄清律师协会的能力以及存在的缺陷。从此,建议解决方案让越南律师协会促进的作用,直接参与法律,以补充和完整和克服当前的立法进程目前的缺点,目的是加强在越南法制。

The important role of the Vietnamese Bar Association has been emphasized in many documents of the Party and the State... in fact, many legislative activities, education and legal publicity, The legal Aid Party and the State have been allocated to the Vietnamese Bar Association, whose status in the political system is evolving. Based on the study and assessment of the current status of the Vietnamese national legislative process and the participation of the Vietnamese Bar Association in the establishment of the legal process in the past, the paper focuses on the main issues:. (a) to study the current legal process; to participate in the establishment of the laws of the Viet Nam Bar Association and the various laws on the status of the specialized institutions... from then on, to assess the effective role of the legislative process and the shortcomings of the existing legal provisions; To evaluate the objectivity and effectiveness of the Vietnamese Bar Association in the legislative process. The suggestion mechanism allows the Bar Association to participate effectively in the legislative process.
