论监察体制改革背景下监、检、法关系新构

【摘要】：监察体制改革是推进国家治理系统现代化和治理能力现代化的重大举措,表明我国反腐机构专门化的发展已经有了非常明确的方向。但反腐的标本兼治不仅是个反腐机构专门化的问题,还是一个反腐新制度、新机制的建设问题。在刑事诉讼领域,监、检、法关系的确立应当符合宪法精神、法治规律和司法规律。监察委员会职权兼有行政权和司法权属性,而现代法治要求监察委员会腐败犯罪调查权应当更加凸显司法权属性。监、检、法关系的新型构建,应当坚持法治原则、"职权等量配置"原则和"兼顾程序"原则,其关系架构应当以"等边三角形"模式为基本形式。"等边三角形"架构有助于:理顺监、检、法权力关系,做好职权分解;划清监、检、法责任界限,加强权力制约;严格监、检、法用权管理,完善权力监督。
[Abstract]:The reform of the supervisory system is a major measure to promote the modernization of the national governance system and the modernization of the governance capacity. This indicates that the development of the specialization of anti-corruption institutions in our country has a very clear direction. But the problem of dealing with both the symptoms and the symptoms of corruption is not only a question of specialization of anti-corruption institutions, but also a question of the construction of a new anti-corruption system and a new mechanism. In the field of criminal proceedings, The establishment of the supervisory, procuratorial and legal relations should conform to the spirit of the Constitution, the law of the rule of law and the law of justice. The functions and powers of the supervisory commission shall have the attributes of both executive power and judicial power. The modern rule of law requires that the investigation power of corruption crimes of the supervisory committee should be more prominent in the attribute of judicial power. The new construction of the relationship between supervision, inspection and law should adhere to the principle of rule by law, the principle of "equal allocation of functions and powers" and the principle of "taking into account the procedure". The relationship structure should take the "equilateral triangle" pattern as the basic form. The "equilateral triangle" structure is helpful for: straightening out the supervision, inspection, legal power relationship, doing a good job of power decomposition; drawing the limits of supervision, inspection, law responsibility, strengthening power restriction; strict supervision, Procuratorate, legal power management, improve power supervision.
