【摘要】：司法是实现社会公平正义的最后一道屏障,法官是行使司法审判职权的神圣使者。法官的自身素质、办案质量和办案效率很大程度上决定了一个国家法治的发展水平。长期以来,我国审判系统处于行政化、地方化等怪圈之中,法官的审判水平参差不齐,法官的工作职责模糊不清、过于笼统,这种职业精英化、专门化、职业化的缺失导致司法公正性的缺乏和司法公信力的下降。法官员额制改革正是为了解决这一难题而设立的,在大力提高法官审判水平和审判效率的基础之上,同时注重法官和辅助人员的职业保障,提高法官职业吸引力,使社会优秀法律人才涌入法院系统,为我国司法事业献力。法官员额制可以强化法院的核心职能——以审判为中心,确保司法公正、提高司法公信力。法官员额制首先要根据当地人口数量、案件多寡、案件类型、法官工作量等合理确定法官员额比例,还要对法院人员进行分类管理,严格确定法官的工作职责,确定司法辅助人员和司法行政人员的职责,使他们既各司其职又互相配合,从而促进审判效率的提升。法官的遴选是法官员额制改革的重头戏,要完善我国法官遴选制度,确立科学的遴选方法,确保进入员额的是真正优秀的法官,要提高他们的职业尊荣感和职业保障,使他们心无旁骛,尽职尽责。要使员额制良性运行,法官的考核和退出机制必不可少,贤者进、庸者退,确保站在审判一线的人员都是称职的、优秀的、真正为人民服务的法官。
[Abstract]:Justice is the last barrier to achieve social fairness and justice, judges exercise judicial authority is the divine messenger. The judge's quality, the quality and efficiency of handling largely determines the development level of a country under the rule of law. For a long time, China's judicial system in administration, such as local circle, judge the trial level is uneven, judge duties vague, too general, this occupation elite, specialized, lack of occupation led to a decrease in the lack of judicial impartiality and judicial credibility. Judicial system reform is set up to solve this problem, improve basic level and efficiency of the trial judge. At the same time, pay attention to occupation judges and support staff, improve the judge occupation appeal, make social outstanding legal talent into the court system, as our country's judicial career offer Force. The system of judges can strengthen the core function of the court in the trial as the center, to ensure judicial justice, improve judicial credibility. The system of judges must first type according to the local population, the number of cases, the case, the judge judges to determine a reasonable proportion of the workload, but also for the classified management of court personnel, strict judge duties sure, the judicial assistants and judicial administrative staff, so that they can carry out their duties and cooperate with each other, so as to promote the efficiency of the trial. The judge selection system of judges is the highlight of the reform, to improve the system of selection of judges in our country, the establishment of scientific selection methods, to ensure access to the posts is really a good judge, to improve their occupation sense of honor and occupation protection, so they intentnesses, due diligence.
