中国地方司法权的内在逻辑

【摘要】：中国的地方司法权,是由其内在逻辑支撑的。基于一切权力属于人民的政治信念,通过人民代表大会制度赋予地方司法机关相应法定的司法职权;中央与地方之间、地方相互之间事权不清,是导致司法职权边界的模糊和实践中地方司法权不稳定的根源,伴随着事权体制的改革,这一问题终将会被解决;我国政治体制的特点以及地域辽阔的现实,决定了地方性差异将长期存在,区域之间的比较与竞争也将长期存在。厘清中央与地方之间的事权关系,合理确定中央与地方、地方之间司法权的权限范围,也是重要的司法改革任务。司法改革应有助于发挥地方在公正司法中的积极作用,而不是简单地“去地方化”。
[Abstract]:The local judicial power in China is supported by its internal logic.Based on the political conviction of the people that all powers belong to the people, through the system of people's congresses, the local judicial organs are given the corresponding statutory judicial functions and powers.It is the root of the blurring of the boundary of judicial authority and the instability of local judicial power in practice. With the reform of the administrative power system, this problem will eventually be solved; the characteristics of our political system and the reality of its vast territory,It determines that local differences will exist for a long time, and regional comparison and competition will also exist for a long time.It is also an important task of judicial reform to clarify the relationship between the central government and the local government and reasonably determine the scope of jurisdiction between the central government and the local government.Judicial reform should help to give play to the positive role of local in fair justice, rather than simply "delocalization".
