家事司法改革中调查官的角色干预

【摘要】：家事案件中道德与法理交织,因此法官在缓和两者之间冲突时倾向于自觉修正立法。家事调查官的设立,有助于法官从实质的角度全面把握案件的事实状况,家事调查官对案件事实的干预是一种分类干预。家事调查官介入家事案件具有天然的优越性,以其辅助法官,可以将家事案件统一于情理与法理,实现公正裁断。
[Abstract]:In family cases, morality and jurisprudence are intertwined, so judges tend to amend legislation consciously.The establishment of the family investigating officer is helpful for the judge to grasp the factual situation of the case from the substantive point of view. The intervention of the family investigating officer on the facts of the case is a kind of classified intervention.It is a natural advantage for a family investigating officer to intervene in a family case. With its auxiliary judge, a family case can be unified into reason and law, and a fair ruling can be realized.
