法院诉讼档案“副卷”改革路径探析——基于基层法院300份诉讼档案“副卷”的分析与审视

【摘要】：法院诉讼档案"副卷"是我国司法实践中的传统而普遍的做法,诉讼档案"副卷"中的材料主要是法院认为需要保密的主观性材料,而不包括证据材料等客观性材料,而且实践中的"副卷"材料也较为集中于合议庭笔录、案件审查报告、审委会讨论记录、裁判文书正本等。从理论上分析,公开诉讼档案"副卷"材料内容并非属于泄露审判秘密,也与损害司法权威、影响法官独立审判不相关联。在当前推进司法体制改革的背景下,应按照司法体制改革的要求,遵循"让审理者裁判,由裁判者负责"的整体思路,对当前诉讼档案"副卷"运行机制进行合理改造,加强相关配套机制建设,进而倒逼司法公开,促进司法责任制的落实。
[Abstract]:The "subsidiary volume" of the court's lawsuit file is a traditional and universal practice in the judicial practice of our country. The material in the "subsidiary volume" of the lawsuit file is mainly subjective material that the court considers it necessary to keep secret, but does not include the objective material such as the evidence material, etc. Moreover, the "subsidiary volume" materials in practice are also concentrated on the collegial bench record, the case review report, the discussion record of the adjudication committee, the original judgment document and so on. Theoretically, the contents of the "subsidiary volume" of the public lawsuit file are not classified as leakage of trial secrets, nor are they related to the damage of judicial authority and the influence on the judge's independent trial. Under the background of pushing forward the reform of the judicial system at present, we should follow the overall idea of "let the adjudicator judge, and let the referee be responsible" in accordance with the requirements of the judicial system reform, and carry out a reasonable reform of the operating mechanism of the current lawsuit file "subsidiary volume". Strengthen the construction of relevant supporting mechanism, then force judicial publicity, promote the implementation of judicial responsibility system.
