【摘要】：服刑人员享有社会权利是其主体资格的内在表现,也是刑罚本质的集中体现。在构建社会主义和谐社会的今天,保障服刑人员的社会权利具有重要的时代意义,它是推进我国人权事业发展的需要,是与国际人权标准接轨的需要,也是维持社会和谐稳定的需要。目前,我国对服刑人员的社会权利保障方面己经取得了明显成绩,但从总体来看还有待于进一步提升。服刑人员作为少数群体,相对于整个国家和社会公众而言,地位较低,因此,他们的社会权利极易被忽视。本文拟从服刑人员的社会保障权等社会权利出发进行分析探讨,进而提出改善服刑人员社会保障权益的建议。本文主要分为五个部分。第一部分作为绪论部分,是对本文行文之前所做论文以及文献研究工作的总括,其中包括论文研究的背景和意义,以及该课题所涉及的国内外相关文献的研究和现状,同时提出本文的研究思路和研究方法。第二部分主要论述服刑人员社会保障权益的基本内涵与现实意义。该部分首先对服刑人员以及社会保障权益等相关概念做出阐述,并提出对于服刑人员社会保障权益研究的依据以及所具有的现实意义。第三部分为案例分析部分,通过对XX市服刑人员的群体进行社会保障权益现状分析,并提出当前服刑人员在社会保障权益中所存在的问题。第四部分主要对当前我国对于服刑人员社会保障权益的保护状况与国外先进国家的情况进行横向对比,并提出对于国外先进经验的借鉴。第五部分是针对前面所述当前我国在服刑人员社会保障权益方面所出现的不足提出建议,具体包括四个方面,分别是坚持以人为本的原则、明确服刑人员的社会保障机制、细化服刑人员社会保障的基本类别、加大对服刑人员的再就业技能培训。
[Abstract]:The social rights enjoyed by prisoners are the internal manifestation of their subjective qualifications and the concentrated embodiment of the essence of penalty. In the construction of a harmonious socialist society today, it is of great significance to protect the social rights of prisoners. It is the need to promote the development of human rights in our country and the need to conform to international human rights standards. It is also the need to maintain social harmony and stability. At present, our country has made obvious achievements in social rights protection of prisoners, but it still needs to be further improved. As a minority group, prisoners have a relatively low status relative to the whole state and the public. Therefore, their social rights are easily ignored. This paper analyzes and discusses the social rights of prisoners, such as the right to social security, and puts forward some suggestions to improve the rights and interests of social security of prisoners. This paper is divided into five parts. The first part, as the introduction part, is a summary of the papers and literature research work done before this article, including the background and significance of the paper research, as well as the research and current situation of the related literature at home and abroad. At the same time, the research ideas and methods of this paper are put forward. The second part mainly discusses the basic connotation and practical significance of social security rights and interests of prisoners. In this part, the related concepts such as prisoners and social security rights and interests are expounded, and the basis and practical significance of the research on the social security rights and interests of prisoners are put forward. The third part is the case analysis part, through the analysis of the current situation of social security rights and interests of the group of prisoners in XX city, and put forward the existing problems of the current prisoners in the social security rights and interests. The fourth part mainly compares the current situation of the protection of the social security rights and interests of the prisoners in our country with that of the foreign advanced countries, and puts forward the reference for the advanced experience of foreign countries. The fifth part is to put forward suggestions in view of the deficiencies in the social security rights and interests of the prisoners mentioned above, including four aspects, which are to adhere to the principle of people-oriented and to make clear the social security mechanism of the prisoners. Refine the basic categories of social security for prisoners and increase the re-employment skills training for prisoners.
