人民法院参与社会管理创新的思考

【摘要】：法律调整人民群众生产生活的方方面面。司法担负着维护社会公平正义、保障人民合法权益、促进社会和谐稳定的神圣使命。司法公正是审判工作的首要目标和最高价值,直接影响到社会稳定和谐。中国特色社会主义是社会主义经济建设、政治建设、文化建设、社会建设的四位一体,作为中国特色社会主义事业的重要组成部分,社会建设和社会管理在新形势下更加重要。社会管理创新又是中央确定的政法工作三项重点之一。司法与社会管理的密切联系,决定了作为审判主体的人民法院应当积极参与社会管理,并应当在参与社会管理创新中大有作为。人民法院参与社会管理创新,需要司法理念的更新、司法实践的创新和司法职能的延伸。本文拟在解析人民法院参与社会管理创新的涵义及意义基础上,通过对人民法院参与社会管理实践经验的调查分析,就人民法院参与社会管理创新的角色定位和实现路径,特别是职能发挥的规范和延伸等问题进行较为深入分析,以期人民法院在社会主义和谐社会的构建中发挥更加积极的作用。文章本论主要由六部分组成。第一部分主要是分析人民法院参与社会管理创新的功能价值,着重论述人民法院参与社会管理创新的意义和必要性;第二部分主要分析人民法院参与社会管理创新的地位,在论述人民法院职能作用的基础上,对人民法院参与社会管理创新的角色定位以及创新内容进行分析;第三部分主要是对人民法院参与社会管理创新情况进行介评;第四、五部分主要是对人民法院参与社会创新的途径和方法进行阐述,第四部分是围绕人民法院职能作用发挥阐述人民法院如何参与社会管理创新,第五部分是分析人民法院参与社会管理创新应当延伸和拓展服务的范围;第六部分则是对于人民法院参与社会管理创新的建议和思考。
[Abstract]:The law regulates all aspects of the people's production and life. The judiciary shoulders the sacred mission of safeguarding social fairness and justice, protecting the legitimate rights and interests of the people and promoting social harmony and stability. Judicial justice is the primary goal and highest value of judicial work, which directly affects social stability and harmony. Socialism with Chinese characteristics is a four-in-one unit of socialist economic construction, political construction, cultural construction and social construction. As an important part of the cause of socialism with Chinese characteristics, social construction and social management are even more important in the new situation. The innovation of social management is also one of the three key points of the political and legal work determined by the Central Committee. The close relationship between the administration of justice and social management determines that the people's court, as the main body of justice, should actively participate in the social management, and should play an important role in the innovation of social management. The people's court participating in the innovation of social management needs the renewal of judicial idea, the innovation of judicial practice and the extension of judicial function. Based on the analysis of the meaning and significance of the people's court's participation in the social management innovation, and through the investigation and analysis of the people's court's practical experience in participating in the social management, this paper aims to position and realize the role of the people's court's participation in the social management innovation. In particular, the regulation and extension of functions are analyzed in depth in order that the people's courts can play a more active role in the construction of a harmonious socialist society. This paper mainly consists of six parts. The first part mainly analyzes the function value of the people's court participating in the social management innovation, emphatically discusses the significance and necessity of the people's court participating in the social management innovation, the second part mainly analyzes the position of the people's court participating in the social management innovation. On the basis of discussing the function of the people's court, this paper analyzes the role orientation and innovation content of the people's court's participation in the social management innovation; the third part mainly introduces and evaluates the people's court's participation in the social management innovation; fourth, The fifth part mainly expounds the ways and methods of the people's court participating in the social innovation. The fourth part is about how the people's court participates in the social management innovation around the function of the people's court. The fifth part is the analysis of the people's court participating in the social management innovation should extend and expand the scope of service; the sixth part is the people's court to participate in the social management innovation suggestions and thinking.
