比较法视野下我国案例指导制度解析

【摘要】：学术界讨论多年的案例指导制度,2010年年末于我国正式确立,《最高人民法院关于案例指导工作的规定》将“判例法”的理想带进我国司法现实,标志着人民法院第二个五年改革纲要中关于案例指导制度构建任务的初步完成。但是我国的案例指导制度并不是单纯的对英美法系判例法的抄袭,也不是对大陆法系判例制度的拷贝,是具有中国特色本土化的判例制度。本文拟在对英美法系判例法和大陆法系判例制度对比分析的基础上,结合《最高人民法院关于案例指导工作的规定》对我国施行之处的案例指导制度做出解析,以期对我国案例指导制度的良好运行和正在起草的《关于案例指导工作的规定》的实施细则提供有益的借鉴。本文共分为四个部分: 导语部分阐述了本文的研究背景和研究思路,其中主要是在2010年《最高人民法院关于案例指导工作的规定》颁布后,我国正式建立起中国特色的案例指导制度,这是本文最大的研究背景也是本文的研究客体。第一章从《最高人民法院关于案例指导工作的规定》中总结出我国案例指导制度的确切定义,明确其“法官释法”的法律性质;又从弥补立法缺陷、规范法官自由裁量权、提高司法效率和促进司法和谐四个层面的价值对案例指导制度建立的必要性进行分析。第二章从比较法角度对英美法系的判例法和大陆法系的判例制度在性质和司法适用两个层面进行了对比分析,指出其本质上的不同——“法官造法”与“法官释法”。第三章是本文重点,以第二章两大法系判例制度为参照物,对我国《最高人民法院关于案例指导工作的规定》从指导性案例的创制和适用两个大角度进行逐条解析。从创制上讲,具有主体的唯一性、程序的严格性、筛选条件的多样性和形式的固定性;从司法适用上讲,《最高人民法院关于案例指导工作的规定》中相关规定具有一定的模糊性和矛盾性,文章通过借鉴其他法系国家的优秀经验,将其具体化、和谐化。
[Abstract]:The case guidance system, which has been discussed for many years in academic circles, was formally established in our country at the end of 2010. The provisions of the Supreme people's Court on case guidance brought the ideal of case Law into the judicial reality of our country. It marks the initial completion of the case guidance system construction task in the second five-year reform outline of the people's court. However, the case guidance system of our country is not merely a copy of the case law of the common law system, nor a copy of the case system of the civil law system, but also a case system with Chinese characteristics. On the basis of the comparative analysis of the case law of common law system and the case system of civil law system, this paper analyzes the case guidance system of our country according to the provisions of the Supreme people's Court on case guidance. It is expected to provide a useful reference for the good operation of the case guidance system in China and the implementing rules of "the provisions on case guidance" being drafted. This paper is divided into four parts: The introduction describes the research background and research ideas of this paper, mainly after the promulgation of the provisions of the Supreme people's Court on case guidance in 2010, the case guidance system with Chinese characteristics was formally established in China. This is the biggest research background and the object of this paper. The first chapter sums up the exact definition of the case guidance system in China from the provisions of the Supreme people's Court on case guidance, clarifies the legal nature of the interpretation of the Law by the judges, and makes up for the defects in the legislation and regulates the discretion of the judges. The value of improving judicial efficiency and promoting judicial harmony analyzes the necessity of establishing case guidance system. The second chapter makes a comparative analysis of the case law of common law system and the case system of civil law system from the angle of comparative law, and points out the essential differences between "judge law" and "judge interpretation law". The third chapter is the focal point of this paper, taking the case system of the second chapter two legal systems as reference, the article analyzes the provisions of the Supreme people's Court on case guidance from two major angles: the creation and application of guiding cases. In terms of creation, it has the uniqueness of the subject, the strictness of the procedure, the diversity of the screening conditions and the fixation of the form. In terms of judicial application, the relevant provisions of the Supreme people's Court on the guiding work of cases have certain ambiguity and contradiction. By using the excellent experience of other legal system countries for reference, the article makes them concrete and harmonious.
