【摘要】：论文主要研究了随着我国司法体制改革的不断深化,监狱文化在我国社会主义文化发展、遵循司法活动规律中的作用,如何在司法体制改革活动中建立具有社会主义特色、体现社会公平正义的监狱文化是非常值得探索的。本文通过文献阅读、访谈、等研究方法,从广义角度系统地研究了涵盖精神和物质两方面的监狱文化,明确了监狱文化具有特殊性、封闭性、强制性和时代性,分析它的功能和研究现状。同时我国司法体制的改革是一个从无到有的过程,要体现司法体制改革精神,要求监狱文化也随司法体制的成长而成长。监狱的文化在建设过程中普遍面临着诸多新情况、新问题和新的任务要求,总结司法体制改革的理论依据和实践价值,最后针对改革形式提出监狱文化建设的指导性措施。监狱文化作为司法体系和社会主义先进文化体系的重要组成部分,成为了服刑人员思想改造的现实基础,能够为促进监狱科学稳定发展提供必要的保障,是保证监狱内部稳定和社会人心安定的重要渠道。要坚持司法体制改革对监狱文化建设的指导,遵循以人为本、文化引领的指导原则,依托发展动力活跃文化氛围,转变监狱工作理念,营造良好的发展氛围是关键。依靠司法体制改革的强大制度动力,加强学习,把个体行为上升为文化意识,创造守法、良好的氛围管理规范,采用思想政治教育、劳动教育等手段科学矫正服刑人员,促进以和谐文化体系为核心的监狱和谐安全发展,以新理念、新手段促进监狱文化建设。
[Abstract]:With the deepening of the judicial system reform in our country, the article mainly studies how to establish the socialist characteristic in the reform of the judicial system by the function of the prison culture in the development of the socialist culture in our country, following the law of judicial activity. The prison culture which embodies social fairness and justice is worth exploring. Through literature reading, interviews, and other research methods, this paper systematically studies prison culture, which covers both spiritual and material aspects from a broad perspective, and makes clear that prison culture has particularity, closeness, compulsion and times. Its function and research status are analyzed. At the same time, the reform of judicial system in our country is a process from scratch to existence. In order to embody the spirit of judicial system reform, prison culture should also grow with the growth of judicial system. Prison culture generally faces many new situations, new problems and new task requirements in the construction process, summarizes the theoretical basis and practical value of the judicial system reform, and finally puts forward the guiding measures for the prison culture construction in view of the reform form. As an important part of the judicial system and the socialist advanced cultural system, prison culture has become the realistic basis for the ideological reform of prisoners, and can provide the necessary guarantee for the promotion of the scientific and stable development of the prison. It is an important channel to ensure prison internal stability and social stability. The key is to adhere to the guidance of the reform of the judicial system to the construction of prison culture, follow the guiding principles of people-oriented and culture-oriented, rely on the development of dynamic and active cultural atmosphere, change the concept of prison work, and create a good atmosphere for development. Relying on the powerful institutional power of the reform of the judicial system, strengthening study, raising individual behavior to cultural awareness, creating law-abiding, good atmosphere management standards, and using ideological and political education, labor education, etc., to scientifically correct prisoners, To promote the harmonious and safe development of prisons with harmonious cultural system as the core, and to promote the construction of prison culture by new ideas and means.
