技术调查官的社会分工意蕴与制度完善研究

【摘要】：为贯彻落实知识产权强国战略、加强对知识产权的司法保护、满足知识产权诉讼技术事实认定的现实诉求,技术调查官已作为一种独立的劳动样式出现在职业群体。以社会分工为视角,系统研究技术调查官制度在国外的发展轨迹与国内的演绎路径,科学界定技术调查官身份归属与职能定位、厘清分工与协作的关系,在借鉴、移植、本土化的过程中从统一选任条件、完善管理模式、构建协同机制、扩大适用范围、健全考核制度等方面积极探索完善我国技术调查官制度的路径,有利于充分发挥技术调查官在技术事实认定中的作用,全面提升知识产权案件的审判质量与效率。
[Abstract]:In order to carry out the strategy of powerful country of intellectual property, strengthen the judicial protection of intellectual property and satisfy the realistic demand of confirming the facts of intellectual property litigation, the technical investigation officer has appeared as an independent labor style in the professional group. From the perspective of social division of labor, this paper systematically studies the development track of technical investigator system abroad and the domestic deductive path, scientifically defines the identity of technical investigator and its functional orientation, clarifies the relationship between division of labor and cooperation, and uses it for reference and transplantation. In the process of localization, we actively explore the ways of perfecting the system of technical surveyors in China from the aspects of unifying the selection conditions, perfecting the management model, constructing the cooperative mechanism, expanding the scope of application, and perfecting the examination system, etc. It is beneficial to give full play to the role of technical investigators in the determination of technical facts, and to improve the quality and efficiency of the trial of intellectual property cases in an all-round way.
