城镇化过程中的征地补偿纠纷解决机制研究

【摘要】：征地补偿纠纷显然是现在的一个很热门的话题,随着城镇化的发展,征地补偿纠纷迅猛增长,并且日益呈现多样化和复杂化。现有纠纷解决机制经过数十年发展已经有了长足发展,也取得了巨大的成果,行政诉讼、行政复议、信访等纠纷解决机制相继建立。但是,这些纠纷解决解决机制之间彼此独立,缺乏有效的衔接,无法形成合力,越来越不能满足日益增长的征地补偿纠纷的现实需要。本文基于城镇化的视角,分析现阶段城镇化过程中征地补偿纠纷频发的原因及其解决现状,在考察现有征地补偿纠纷解决机制类型及其具体运行的基础上,探索建构我国特色城镇化过程中的多元化征地补偿纠纷解决机制。文章共分四个部分： 第一部分为绪言。主要介绍了征地补偿纠纷及征地补偿纠纷解决机制的渊源,考察了征收、征用与征地补偿纠纷的关系,简明概括了征地补偿纠纷解决机制的相关界定及其研究背景和发展现状。最后,阐述了本文的研究方法、目的以及对解决现阶段征地补偿纠纷的意义。 第二部分主要阐述城镇化过程中的征地补偿纠纷。首先分析了城镇化的定义和特征,以及基于城镇化视角对征地补偿纠纷进行了基本的界定,并分析了在城镇化视野下现有征地补偿纠纷具有的特征。这一部分的重点在于探究城镇化过程中征地补偿纠纷频发的原因及其表现出来的与以往征地补偿纠纷所不一样的特征,随后考察了现有征地补偿纠纷解决现状,并在此基础上初步总结征地补偿纠纷解决的意义。 第三部分是城镇化过程中的征地补偿纠纷解决机制及其运行。首先,逐一解析现阶段征地补偿纠纷解决机制的主要类型,确定征地补偿纠纷解决机制的具体分析范围；其次,分析影响征地补偿纠纷解决机制选择的各种因素与评价标准,探究人们对各种纠纷解决机制选择背后的影响因素以及他们在何种标准上判断一个解决机制的好坏；最后,重点选取了行政诉讼、行政复议、信访和行政调解制度这几个最常见的解纷机制进行具体研究,考察这些制度在城镇化过程背景下的征地补偿纠纷中的具体运行及暴露出来的问题,为后面探索如何完善发展这些机制,并在此基础上构建中国城镇化特色的多元化征地补偿纠纷解决机制做一前提性研究。 第四部分是文章的最后一部分,是在前文的基础上探索一个适应中国特色城镇化道路的多元化征地补偿纠纷解决机制。首先阐述了多元化征地补偿纠纷解决机制构建应该遵循的基本路径和几个原则,认为构建多元化征地补偿纠纷解决机制必须践行和谐社会理念,综合考量政府与人民的利益,坚持走中国特色城镇化道路,并应当遵循“穷尽行政救济”、司法主导等基本原则。其次,探索构建多元化征地补偿纠纷解决机制的具体措施,在对现有纠纷解决机制的缺陷分析的基础上,认为要完善行政诉讼制度、改革信访制度、重构行政复议制度。最后,多元化征地补偿纠纷解决机制的建立还需要发展新的纠纷解决机制,应当在行政诉讼和解、行政诉讼调解、土地裁决制度以及征地补偿纠纷预防机制等方面进行创新探索。
[Abstract]:With the development of urbanization , the dispute settlement mechanism of land requisition compensation dispute has been established successively . However , the existing dispute settlement mechanism has been developed in many decades and has made great achievements , administrative litigation , administrative reconsideration , and petition and other dispute resolution mechanisms have been established successively .

The first part is introduction . Mainly introduces the origin of land requisition compensation dispute and the dispute settlement mechanism of land requisition and compensation , investigates the relation between expropriation , requisition and expropriation compensation dispute , summarizes the relevant definition of the dispute settlement mechanism of land requisition and compensation , and the research background and development status quo . Finally , this paper expounds the research methods and purposes of this paper and the significance of solving the dispute of expropriation compensation at this stage .

The second part mainly expounds the dispute of land requisition compensation in the process of urbanization . Firstly , the definition and characteristics of urbanization are analyzed , and the characteristics of the existing land requisition compensation dispute in the view of urbanization are analyzed .

The third part is the land requisition compensation dispute settlement mechanism and its operation in the process of urbanization . Firstly , the main types of the dispute settlement mechanism are analyzed one by one , and the specific analysis scope of the dispute settlement mechanism is determined .
Secondly , the paper analyzes the factors and the evaluation criteria which influence the selection of the dispute settlement mechanism , and probes into the influencing factors behind the choice of various dispute resolution mechanisms and how they judge a solution mechanism .
Finally , the thesis focuses on the specific research on the most common anti - dispute mechanisms , such as administrative litigation , administrative reconsideration , complaint and administrative mediation system , and explores the specific operation of these systems in the context of urbanization and the problems exposed , and provides a precondition for exploring how to perfect these mechanisms and to build a diversified land requisition compensation dispute settlement mechanism with Chinese urbanization characteristics .

The fourth part is the last part of the article , which is based on the previous text to explore a multi - expropriation compensation dispute settlement mechanism adapted to the urbanization road with Chinese characteristics .
