人民监督员制度的现状、问题及完善

【摘要】:为了加强外部监督,切实防止和纠正检察机关查办职务犯罪工作中执法不公的问题,根据宪法和法律关于一切国家机关必须倾听人民的意见、接受人民的监督的规定,最高人民检察院经报告全国人大常委会并经中央同意,从2003年9月起开展人民监督员制度试点工作,并在天津、河北、内蒙古等10个省(区、市)检察机关试点,后又报经批准于2004年8月部署扩大试点范围。实践表明,人民监督员制度的推行,有效地制约了检察机关检察权的行使,保护了犯罪嫌疑人的合法权利,促进了程序公正,进一步推进了我国社会主义法治的建设。但与此同时,人民监督员的缺点与不足也进一步的显现了出来,如人民监督员的选任制度不够合理、监督的强制约束力不足、监督程序不完善、人民监督员的经费与完全保障不足等等,这些都直接制约着人民监督员制度效果的进一步发挥。基于此,有必要对人民监督员制度进行进一步完善。 本文结构上主要包括以下内容:一是人民监督员制度概述。主要论述了人民监督员制度的创设背景,并简要概括了人民监督员制度的主要内容。二是人民监督员制度的设立依据和作用。论述了人民监督员制度的设立依据,总结了人民监督员制度的意义,并阐述了人民监督员制度目前所取得的成效。三是人民监督员制度的完善。本章指出了我国人民监督员制度的在选任、任期、监督的强制约束力、人民监督员的了聘任、监督程序、制度保障等方面的不足,并提出了完善措施。
[Abstract]:In order to strengthen external supervision and effectively prevent and correct the problem of unfair administration of justice in the investigation and handling of job-related crimes by procuratorial organs, according to the provisions of the Constitution and the law that all state organs must listen to the opinions of the people and accept the supervision of the people, After reporting to the standing Committee of the National people's Congress and with the approval of the Central Committee, the Supreme people's Procuratorate has carried out the pilot work of the people's Supervisor system since September 2003, and has carried out pilot projects in 10 provinces (autonomous regions and municipalities), including Tianjin, Hebei and Inner Mongolia. Later approved in August 2004 to expand the scope of the pilot. Practice shows that the implementation of the people's Supervisor system has effectively restricted the exercise of procuratorial power of procuratorial organs, protected the legitimate rights of criminal suspects, promoted procedural justice, and further advanced the construction of socialist rule of law in China. At the same time, however, the shortcomings and deficiencies of the people's supervisors have also been further revealed. For example, the selection and appointment system of the people's supervisors is not reasonable, the compulsory binding force of the supervision is insufficient, and the supervisory procedures are not perfect. The funds and the complete guarantee of the people's Supervisors are insufficient, which directly restricts the further development of the effect of the people's Supervisors system. Based on this, it is necessary to further improve the system of people's supervisors. The structure of this paper mainly includes the following contents: first, the outline of the people's Supervisor system. This paper mainly discusses the background of the establishment of the people's Supervisor system, and briefly summarizes the main contents of the people's Supervisor system. Second, the establishment of the people's Supervisor system and the role of the basis. This paper discusses the basis for the establishment of the people's Supervisor system, summarizes the significance of the people's Supervisor system, and expounds the achievements of the people's Supervisor system at present. Third, the improvement of the system of people's supervisors. This chapter points out the deficiencies of the people's Supervisor system in the selection, tenure, compulsory binding force of supervision, the appointment of the people's Supervisor, the procedure of supervision and the guarantee of the system, and puts forward some measures to improve it.
