公证制度在网络取证中的适用

【摘要】：公证制度有其独特的价值,契合于网络证据的特殊性,使得其在网络取证中有着不可替代的作用。但是面对互联网的发展,传统公证模式已不再适合于网络证据的收集与保全。同时中国涉及网络证据公证的法律资源匮乏,阻碍了公证在网络取证中的运用。网络科技日新月异,如何在这股大潮流中建立科学的公证法律制度,考验着立法者的智慧与决心。中国应在法定程序的制定与网络公证中心的建立上做出努力,以激发公证制度在网络时代的价值。
[Abstract]:The notarization system has its unique value, which accords with the particularity of the network evidence, and makes it play an irreplaceable role in the network forensics. However, in the face of the development of the Internet, the traditional notarization model is no longer suitable for the collection and preservation of online evidence. At the same time, the lack of legal resources related to the notarization of online evidence hinders the application of notarization in the network. With the rapid development of network science and technology, how to establish a scientific legal system of notarization in this trend tests the wisdom and determination of legislators. In order to stimulate the value of notarization system in the network era, China should make efforts in the establishment of legal procedure and the establishment of network notarization center.
