论利益衡量方法在行政审判中的运用

【摘要】：在审判中法官应当根据一定的价值判断进行取舍,妥当地平衡相互冲突各方的利益。做好利益衡量。必须遵守整体利益最大化、损害最小化、充分正当性、社会一般标准和利益衡量的谦抑原则。《行政诉讼法若干解释》第58条的规定是利益衡量方法在行政诉讼中典型的具体体现。法官的判决取决于利益衡量的结果。当公共利益在利益衡量中取得优先地位时,这种优先并不是对个人利益的消弭,而仅仅是保障次序上的先后。在优先保护公共利益的前提下,必须对个人利益所遭受的侵害给予弥补,努力寻找一条协调公共利益与个人利益的路径。
[Abstract]:In the trial, the judge should choose and choose according to certain value judgment, and balance the interests of conflicting parties properly. Make a good balance of interests. Article 58 of the Administrative procedure Law is a typical embodiment of the method of interest measurement in administrative litigation. The judge's decision depends on the outcome of the measure of interest. When public interest takes precedence in interest measurement, this priority is not the elimination of personal interest, but only the order of protection. On the premise of giving priority to the protection of public interests, we must make up for the infringement of personal interests and try to find a way to coordinate public interests with personal interests.
