【摘要】：刑事司法参与型非政府组织是指以参与刑事司法活动为宗旨建立起来的具有组织性,非政府性,非营利性,中立性,法律性等特征的社会组织。在我国当前具有有利于市民社会的发育与成长,缓和阶层矛盾,凝聚社会意志的社会价值;改善公权力机关权力行使理念,培育刑事司法文化,提升刑事司法文明水平,推进刑事司法改革的法律价值;及促进非政府组织整体完善与发展等诸多价值。但我国当前刑事司法参与型非政府组织的发展中却面临着缺乏足够支持力度;管理机制不健全;自我管理行政化;自我发展能力弱等难题。要解决上述问题,必须从加大培育力度和强化监督规制两方面着手。就加大培育力度而言,其主要措施包括拓宽组织生存空间,加大扶持力度;理顺管理体制,为组织发展创造良好的外部环境;明确组织属性,保障自主发展;培育组织自我发展能力等。就强化监督规制而言,其主要措施包括构建严格的动态监督制度;制定完善的责任承担机制与惩戒机制;强化社会监督;加强组织自律建设;实现财务公开透明等。通过采取上述措施保证我国刑事司法参与型非政府组织的健康有序发展,进而有效地提高我国的刑事司法的现代化、法治化水平,有力的推进我国社会主义法治国家建设事业的顺利进行。
[Abstract]:Criminal judicial participation NGOs are social organizations with the characteristics of organization, non-government, non-profit, neutrality, law and so on, which are established for the purpose of participating in criminal justice activities. In our country, it has the social value of helping the development and growth of civil society, easing the social contradiction, condensing the social will, improving the concept of power exercise of the public power organs, cultivating the criminal judicial culture, and improving the level of criminal justice civilization. To promote the legal value of criminal justice reform, and to promote the overall improvement and development of non-governmental organizations and many other values. However, in the development of the criminal judicial participating NGOs in our country, they are faced with the following problems: lack of sufficient support, imperfect management mechanism, self-administration, weak self-development ability and so on. In order to solve the above problems, we must strengthen the cultivation and strengthen the supervision and regulation. In terms of strengthening cultivation, the main measures include broadening the living space of organizations, strengthening support, straightening out the management system, creating a good external environment for the development of organizations, clarifying organizational attributes and ensuring independent development. Cultivate organization self-development ability and so on. As far as strengthening supervision and regulation is concerned, its main measures include constructing strict dynamic supervision system, establishing perfect responsibility bearing mechanism and disciplinary mechanism, strengthening social supervision, strengthening self-discipline construction of organizations, realizing financial transparency and so on. By taking the above measures to ensure the healthy and orderly development of the non-governmental organizations involved in criminal justice in our country, we can effectively improve the modernization and legalization of criminal justice in our country. To promote the construction of China's socialist country ruled by law smoothly.
