法官助理制度改革需求与法治人才培养创新

【摘要】：法官员额制和法官助理制度的改革,呈现出改革推动高位化、性质定位职业化、管理序列单独化、人员来源多样化、基本职责明晰化趋向,这既为法治人才带来了新的市场需求,又提出了法科学生向"熟手"助理迅速转变的素质需求。《司法责任制意见》对法官助理职责界定为审判业务辅助,为法治人才培养及素质训练提供了标尺基于法官助理所承担的诸多职责,应着重培养和训练法治人才的理念(司法良知、法律信仰和法治思维)、知识(法律知识和社会知识)和技能(法律运用、人际沟通、纠纷化解和文书写作)。在法治人才的培养方式和机制创新上,应推进职业教育的坚持与深化、法院与高效的有效互动、专业能力与"关键能力"的有机统一、考核方式的不断丰富等。
[Abstract]:The reform of the post system of judges and the system of assistant judges shows that the reform promotes the high position, the nature orientation, the professionalization, the separate management sequence, the diversification of the personnel sources, and the clear trend of the basic duties. This not only brings new market demand to the qualified personnel under the rule of law, but also puts forward the quality demand of the law science students changing rapidly to the "familiar" assistant. The opinion of Judicial responsibility system defines the duty of the assistant judge as the assistant of the trial business. It provides a yardstick for the cultivation and quality training of talents under the rule of law. It is based on the many duties of assistant judges, and should focus on the concept of cultivating and training talents of rule of law (judicial conscience, justice and conscience). Legal beliefs and legal thinking, knowledge (legal knowledge and social knowledge) and skills (legal application, interpersonal communication, dispute resolution, and paperwork). In the innovation of cultivation and mechanism of talents under the rule of law, we should promote the persistence and deepening of vocational education, the effective interaction between courts and efficiency, the organic unification of professional ability and "key ability", and the constant enrichment of examination methods.
