【摘要】：法律监督权是我国宪法赋予检察机关的一项极为重要的权力。而民事诉讼法律监督,则是检察机关履行法律监督权的重要组成部分。在保护当事人合法权益、维护司法公正等方面发挥了积极的作用。但是,随着民事诉讼法律检察监督工作的不断逐渐深入的开展,现行的民事法律监督机制的缺陷也日益的暴漏和凸显出来。本文力图通过使用与民事诉讼法律检察监督相关的数据和笔者在检察院实习的所见所感,直观的反映出目前我国民事诉讼法律监督工作特别是地方检察机关所处的困境和急需解决的问题。其中民事诉讼检察监督工作中的问题主要存在以下几点:第一,民事诉讼检察监督案件的案源逐年减少,案件总量降低。第二,受理案件数、立案数和抗诉案件数之间存在结构矛盾。第三,当事人对民事检察监督工作的认识程度不高。第四,民事检察监督工作的开展存在不平衡。究其原因,这些问题的产生主要是由于民事诉讼法律监督机制在立法上的缺失、民事诉讼监督司法过程中的存在不足以及对民事诉讼监督检察工作的不够重视这三大原因的共同作用下的产物。建议地方检察机关逐步展开拓展民事诉讼监督案件案源工作,以使得民事诉讼监督工作有一个足够大的空间。进一步完善民事诉讼监督相关立法,保证检察机关展开民事诉讼监督工作有法可依。最后,优化民事诉讼检察监督工作外部的硬环境到内部的软环境,从而真正达到促进民事诉讼检察监督工作的作用。
[Abstract]:The power of legal supervision is an extremely important power given to the procuratorial organ by the constitution of our country. The legal supervision of civil procedure is an important part of the procuratorial organ to fulfill the power of legal supervision. It has played an active role in protecting the legitimate rights and interests of the parties and safeguarding judicial justice. However, with the gradual development of the procuratorial supervision of civil procedure law, the defects of the current civil legal supervision mechanism are increasingly leaked and highlighted. This paper tries to use the data related to the procuratorial supervision of civil procedure law and the experience of the author in the practice of procuratorate. Intuitively reflects the current civil litigation legal supervision work, especially the local procuratorial organs in the plight and urgent need to solve the problem. The main problems in the work of procuratorial supervision of civil proceedings are as follows: first, the source of cases of procuratorial supervision in civil litigation has been reduced year by year, and the total number of cases has decreased. Second, there are structural contradictions between the number of cases accepted, the number of cases filed and the number of protest cases. Third, the parties to the civil procuratorial supervision of the degree of understanding is not high. Fourth, there is imbalance in the development of civil procuratorial supervision. The reason is that the causes of these problems are mainly due to the lack of legislation in the legal supervision mechanism of civil proceedings. The defects in the judicial process of the supervision of civil proceedings and the insufficient attention to the procuratorial work of the civil litigation are the product of the joint action of these three major reasons. It is suggested that the local procuratorial organs should gradually expand the work of supervising cases in civil litigation so as to have a large enough space for the supervision of civil proceedings. Further improve the civil litigation supervision legislation to ensure that procuratorial organs to carry out civil litigation supervision work in accordance with the law. Finally, optimize the external hard environment to the internal soft environment of the procuratorial supervision of civil litigation, so as to achieve the role of promoting the procuratorial supervision of civil litigation.
