法院人员分类管理制度研究

【摘要】：在新一轮的司法改革中,中央明确提出要完善司法人员分类管理制度,法院人员分类管理制度是司法人员分类管理制度的重要方面。健全法院人员分类管理制度,符合司法权自身的运行规律,是法官职业化的必然要求,是法官独立、公正行使审判权的有力保障。当前,我国法院人员分类管理制度依旧受传统管理体制的惯性所影响,存在相关法律滞后、法官员额的科学标准还未建立等问题。为进一步完善法院人员分类管理制度,应及时修改相关立法、建立科学的法官员额核定标准并完善法官遴选机制。
[Abstract]:In the new round of judicial reform, the central government has clearly proposed to improve the classified management system of judicial personnel, and the classified management system of court personnel is an important aspect of the classified management system of judicial personnel. Perfecting the classified management system of court personnel accords with the running law of judicial power itself, it is the inevitable requirement of judge professionalization, and it is the strong guarantee of judge's independence and fair exercise of judicial power. At present, the classified management system of court personnel in our country is still influenced by the inertia of the traditional management system, and there are still some problems such as the lag of relevant laws and the unestablished scientific standard of judges' posts. In order to further improve the classified management system of court personnel, we should amend the relevant legislation in time, establish scientific criteria for the approval of judges' posts and perfect the selection mechanism of judges.
