黑龙江省边境贸易海关知识产权保护的风险研究

【摘要】：知识经济时代,知识产权保护制度已经成为各国发展经济和参与国际竞争的重要基础。但是由于知识产权的潜在财产价值,侵犯知识产权之非法货物的国际贸易数量一直呈上升趋势,给正当的国际贸易带来了巨大的损失风险,国际社会越来越认识到海关知识产权保护在知识产权保护法律体系中的重要性。本文力图从法学基础理论和司法实际应用两个层面对黑龙江省边境贸易海关知识产权保护进行系统研究。比较美国、日本、欧盟等国家和组织的相应框架,结合我国和黑龙江省海关知识产权保护的实际情况,黑龙江省边境贸易海关知识产权保护中存在诸多风险及漏洞,加强黑龙江省海关知识产权保护必要也紧迫。应当从程序和实体双重角度来防范相关风险及完善黑龙江边贸海关知识产权保护制度。由此,建议规范海关知识产权保护申请制度,建立申请受理中心系统；规范海关知识产权保护备案制度,加强主动保护力度；规范海关知识产权保护担保制度；适度扩大申请主体范围,将其他权利持有人纳入申请主体范围；扩大海关知识产权保护的环节,将加工贸易环节纳入保护范围；改革原有的专利海关保护模式,将对专利的保护仅限于被动保护模式；适时缩小海关知识产权保护的对象；完善海关知识产权保护刑事责任体系等。
[Abstract]:In the era of knowledge economy, intellectual property protection system has become an important foundation for countries to develop economy and participate in international competition. However, due to the potential property value of intellectual property, the amount of international trade in illegal goods infringing on intellectual property has been on the rise, which has brought enormous loss risks to legitimate international trade. The international community is becoming more and more aware of the importance of customs intellectual property protection in the legal system of intellectual property protection. This paper tries to make a systematic study on the protection of border trade customs intellectual property rights in Heilongjiang Province from two aspects: the basic theory of law and the practical application of judicature. Comparing the corresponding frameworks of the United States, Japan, the European Union, and other countries and organizations, and combining the actual situation of China and Heilongjiang Province in the protection of customs intellectual property rights, there are many risks and loopholes in the protection of border trade customs intellectual property rights in Heilongjiang Province. It is necessary and urgent to strengthen the protection of the intellectual property rights of Heilongjiang Customs. It is necessary to guard against the related risks from the point of view of procedure and entity and to perfect the protection system of Heilongjiang border trade customs intellectual property rights. Therefore, it is suggested to standardize the application system for the protection of customs intellectual property rights, to establish a system of accepting and accepting applications, to standardize the record system of the protection of customs intellectual property rights, to strengthen the intensity of active protection, to standardize the guarantee system for the protection of intellectual property rights To appropriately expand the scope of the subject of the application and bring other rights holders into the scope of the subject of the application; to expand the links of the protection of the intellectual property rights of the customs, to bring the links of processing trade into the scope of protection; and to reform the original patented customs protection mode, The patent protection is limited to passive protection mode; the object of customs intellectual property protection is reduced in time; the criminal liability system of customs intellectual property protection is improved.
