强制医疗执行监督的强化

【摘要】：强制医疗制度司法化以来,检察机关积极探索派驻检察及巡回检察监督方式,依法开展强制医疗执行监督工作,取得了一定成效。但同时,也面临着强制医疗执行主体多元化、执行规范缺乏、获取信息难、经费保障不足、队伍建设薄弱等问题。建议尽快出台"强制医疗执行条例",建立强制医疗执行信息共享平台,推进对强制医疗所的派驻检察,加强刑事执行检察队伍建设,完善强制医疗执行救济程序,加强和完善强制医疗执行监督。
[Abstract]:Since the compulsory medical treatment system has been judicialized, procuratorial organs have actively explored the way of procuratorial supervision and itinerant procuratorial supervision, and carried out the work of compulsory medical enforcement supervision according to law, which has achieved certain results. But at the same time, it also faces many problems, such as diversification of compulsory medical executive body, lack of execution standard, difficulty in obtaining information, insufficient fund guarantee, weak team construction, etc. It is suggested that the "regulations on compulsory Medical Enforcement" be promulgated as soon as possible, that a platform for sharing information on compulsory medical execution be established, that procuratorial personnel be stationed in compulsory medical institutions, that the construction of procuratorial teams for criminal enforcement be strengthened, and that the relief procedures for compulsory medical execution be improved. We will strengthen and improve the supervision of compulsory medical treatment.
