【摘要】:1980年,我国恢复了律师制度。我国的律师业经过三十多年的发展,业务能力、管理体制、管理水平都取得了巨大进步,从业律所的规模和律师素质得到了较大提高,律师业面貌整体焕然一新,在全社会取得了较好声誉。但是,从世界律师行业的发展现状来看,特别是以发达国家的标准来看,我国律师业的发展还处于初级阶段。特别是加入世贸组织后,更需要我国形成一批专业化强、规模层次高、业务能力强的一流律师事务所,否则将无法与实力雄厚的外国律师事务所抗衡,为社会主义事业提供强有力的法律支持也将成为一句空话。严峻的现实表明,必须改进工作方法、完善考评机制,进一步激发律师事务所工作人员的工作热情和工作积极性,使律师事务所朝着科学化、规范化的方向不断前进。为了实现这个目标,从制度上、根本上使律师事务所迸发出无穷活力,我们要根据行业发展的方向和重点,有计划、有针对性地对律师事务所的考评机制进行一次全面的调查研究,查找出存在的问题,确定出既切合实际又特色鲜明的考核办法,从而为律师事务所行业带来新的生机和活力。 本文以L律师事务所为例,对律师事务所绩效考核方案进行研究和再设计。主要包括概述律师事务所绩效考核现状、分析考核存在的缺陷和不足、阐述对考核方案进行改进的意义、提出对考核体系进行再优化后的方案。其中,对考核体系的再优化是本文的重点。在这一章里,通过论述绩效考核的原则和思路,对被考核对象进行调查,得出被考核对象对考核的意见建议,然后优化考核方案,展示优化后方案的应用方法和预期效果。 本文通过对律师事务所绩效考核方面的概括性研究,对其进行了绩效考核方案的优化设计。设立了科学合理的评估标准。将评估依据设计得标准全面,关键的标准有连续性、可量化、体现整体性;评估过程较为完整;提高了员工对考评的信服度,以期为律师事务所考核体系的不断完善和规范提供一些借鉴和启示。
[Abstract]:In 1980, our country restored the lawyer system. After more than 30 years of development, the legal profession in our country has made great progress in terms of its professional ability, management system and management level. The scale and quality of the legal firms have been greatly improved, and the overall face of the legal profession has taken on a completely new look. It has gained a good reputation in the whole society. However, judging from the current situation of the world's lawyer industry, especially by the standards of the developed countries, the development of our country's lawyer industry is still in the primary stage. Especially after China's accession to the WTO, it is even more necessary for our country to form a number of first-class law firms with strong specialization, high level of scale, and strong business capability. Otherwise, they will not be able to compete with strong foreign law firms. To provide strong legal support for the cause of socialism will also be empty talk. The austere reality shows that it is necessary to improve the working methods, perfect the examination and evaluation mechanism, further stimulate the work enthusiasm and enthusiasm of the staff of the law firms, and make the law firms move toward the direction of science and standardization. In order to achieve this goal, the law firms are fundamentally energized by the system. We must plan according to the direction and focus of the development of the industry. This paper makes a comprehensive investigation and study on the examination and evaluation mechanism of law firms, finds out the existing problems, and determines the examination methods which are both practical and distinctive, thus bringing new vigor and vitality to the law firm industry. This paper takes L law firm as an example to study and redesign the performance appraisal scheme of law firm. It mainly includes summarizing the present situation of the performance appraisal of the law firm, analyzing the defects and shortcomings of the appraisal, expounding the significance of improving the examination scheme, and putting forward the plan after the re-optimization of the appraisal system. Among them, the re-optimization of the assessment system is the focus of this paper. In this chapter, through discussing the principle and train of thought of performance appraisal, the author investigates the object under examination, and draws the opinion and suggestion of the subject, then optimizes the evaluation scheme, and shows the application method and expected effect of the optimized scheme. Based on the general research on the performance appraisal of law firms, the optimization design of the performance appraisal scheme is carried out in this paper. Scientific and reasonable evaluation criteria have been established. The evaluation will be based on the design criteria comprehensive, the key criteria have continuity, quantifiable, reflect integrity; the evaluation process is relatively complete; improve the staff's confidence in the evaluation, In order to continue to improve and standardize the examination system of law firms to provide some reference and inspiration.
