我国女子监狱一线民警权益保障问题研究

【摘要】：监狱人民警察是我国众多警种当中较为神秘的一支,由于其封闭的工作环境以及特殊的职业责任,使得社会大众对其的了解程度十分有限,而受传统观念对于警察身份的设定以及近年来社会普遍关注的监狱罪犯等弱势群体权益等因素的影响,我国监狱人民警察的形象甚至被妖魔化,即使在与罪犯接触中的合法教育改造行为,也会被认定为“践踏人权”、“虐待囚犯”,而对于日渐严重的“袭警行为”,多数时候,一线狱警也都选择了隐忍、退让的处理方式,生怕影响警民关系,损害人民警察形象。女子监狱一线民警作为监狱警察中的少数特殊群体,在承担着教育改造我国数量日渐增多、罪行日渐严重的女性罪犯的同时,自身权益受损程度较之普通男性监狱警察,有过之而无不及。随着社会法制意识的普遍提升,以及监狱内部生活越加对外公开,监狱警察、尤其是一线监狱民警的权益保障问题逐渐引起社会各界广泛重视。本文主要就目前我国女子监狱一线民警的权益保障工作存在的问题及解决方法进行研究讨论,文章首先就研究问题所需相关理论及概念进行概括性描述,为整个研究工作提供理论支持;第三章则说明我国目前女子监狱一线民警权益保障工作存在的问题及成因;随后在第四章中对国外监狱警察权益保障工作相对完善国家的保障工作措施进行举例说明,为本文研究提出外部参考;第五章则是在综合上述各章内容基础之上,从国家立法、监狱体制改革、个人素质提升以及社会环境影响四方面因素入手,全面提出加强我国女子监狱一线民警权益保障工作的具体措施内容。
[Abstract]:The prison people's police are one of the more mysterious among the many policemen in our country. Because of their closed working environment and special occupational responsibility, the public's understanding of the police is very limited, but it is limited by the public's understanding of the police, and the rights and interests of the vulnerable groups such as the prison criminals, such as the prison criminals, which have been paid more and more attention in recent years, are due to the traditional concept of the police. The image of the prison people's police in our country is even demonized. Even in the legal education reform in contact with the criminals, it will be identified as "trampling human rights" and "abusing prisoners". For the increasingly serious "assaulting police behavior", most of the time, the first line of the prison police also chose to bear, the way to deal with the retreat, to be afraid of the shadow. The relationship between the police and the people will damage the image of the people's police.
As a few special groups in the prison police, the frontline police of the women's prisons have been unable to do so at the same time that their own rights and interests are more damaged than those of the ordinary male prison police.
With the general promotion of social legal consciousness and the more and more public life in the prison, the problem of the protection of the prison police, especially the front line prison police, has gradually aroused the attention of all walks of life.
This article mainly discusses the existing problems and solutions for the rights and interests of the women's prison front-line police in China. The article first gives a general description of the related theories and concepts needed to study the problems, and provides theoretical support for the whole research work. The third chapter illustrates the current rights and interests of the women's prison lines in China. The problems and causes of the guarantee work exist, and then in the fourth chapter, we give an example to illustrate the safeguards of the foreign prison police in a relatively perfect state and provide an external reference for this study. The fifth chapter is on the basis of the comprehensive contents of the above chapters, from the national legislation, the prison system reform, and the promotion of individual qualities. And four aspects of social environmental impact, and put forward the specific measures to strengthen the protection of the rights and interests of frontline police officers in China's women's prison.
