错案责任追究机制之反思——兼议我国司法责任制度的完善进路

【摘要】：由于事实生成过程以及法律适用结论的可错性,我们不可能设定出逻辑圆洽的错案实体标准,因此,"错案"无法作为一个法学或法律专业术语而成立。这也就意味着当下对错案的认知存在方向性偏差,而相应司法责任追究机制的设置不仅仅是一种制度建设浪费,更是一种逻辑上无法成立因而应当予以摒弃的司法改革举措。当然,主张废止"错案"概念以及当前错案责任追究机制并不意味着对它曾具有的积极价值之全面否定,更不意味着我们只能放任法官任意或恣意裁判,而仅仅意味着需要换一种规训司法的思路,即由"结果-实体"导向的错案责任追究换作"行为-程序"导向的司法责任监控。
[Abstract]:Due to the fact generation process and the error-ability of the conclusion of law application, it is impossible to set up a logical circle consistent substantive standard of wrong case. Therefore, "wrong case" cannot be established as a legal or legal term. This also means that there is a directional bias in the cognition of wrong cases, and the establishment of the corresponding judicial accountability mechanism is not only a waste of system construction, but also a measure of judicial reform that cannot be established logically and should be abandoned. Of course, advocating the abolition of the concept of "wrong cases" and the current mechanism of accountability for wrongful cases does not imply a total denial of its positive value, nor does it mean that we can only allow judges to decide arbitrarily or arbitrarily. But it only means that we need to change the train of thought of discipline and judicature, that is, the responsibility investigation of wrong cases guided by "result-entity" is replaced by "behavior-procedure"-oriented judicial responsibility monitoring.
