反渎职侵权“三难一大”问题研究

【摘要】：反渎职侵权工作负责对国家机关工作人员渎职犯罪立案侦查,可以使程序性纠正监督与实体性责任监督有机结合,使司法公正得到切实的保障。反渎职侵权工作是检察机关实施法律监督的重要组成部分,是检察机关依照宪法和法律,正确履行法律监督职责,依法惩治和预防渎职侵权犯罪,促进依法行政,维护司法公正,推动经济发展,服务构建和谐社会的基本技能和本领。渎职侵权是对民主法治、公平正义的破坏,反渎职侵权工作对促进社会主义经济建设、和谐社会建设具有重大意义。在基层的检察院反渎职侵权局实习了五个月,发现在工作中会遇到一些常见的问题,在对这些问题进行归纳、总结并且向反渎职侵权工作人员咨询后,得出在反渎职侵权工作中会遇到像案源发现难、调查取证难、处理难、办案阻力大等问题,严重的影响了反渎职侵权工作的进行,本文准备通过用发现问题,找出问题的原因,解决问题的思维方法,来实现对反渎职侵权工作中问题的探究,以求得解决反渎职侵权工作中遇到的问题。论文的第一部分主要是将反渎职侵权工作中的问题进行了归纳,阐述哪些问题影响基层检察院反渎职侵权工作,第二部分将反渎职侵权工作中问题形成原因,从社会认知度,犯罪主体的特殊性,证人作证等方面进行了分析,指出造成反渎职侵权工作困境的原因是多种多样的,本文的最后一部分是重心,拟通过建立侦查一体化、加强新闻媒体监督等方面,来解决反渎职侵权工作中的问题。本文密切结合在基层检察院实习的经验,与立法、司法实践经验主要是检察院前辈的经验相结合,理论与实际联系,在前人的研究成果基础上,对反渎职侵权工作中遇到的问题进行归纳,提炼出问题的共同的原因,从而找出解决的办法。希望能通过本文给基层的反渎职侵权的工作一些建议和意见。
[Abstract]:Anti-malfeasance tort work is responsible for investigating the malfeasance crime of state functionaries, which can combine procedural correction supervision with substantive responsibility supervision and ensure the judicial justice. Anti-malfeasance infringement is an important part of the procuratorial organ's implementation of legal supervision. It is the procuratorial organ, in accordance with the Constitution and law, correctly performs its duties of legal supervision, punishes and prevents the crime of malfeasance according to law, and promotes administration according to law. Maintain judicial justice, promote economic development, and serve the basic skills and skills of building a harmonious society. Malfeasance infringement is the destruction of democracy and rule of law, fairness and justice. After a five-month internship at the grass-roots procuratorate's Anti-malfeasance and Tort Bureau, we found that we would encounter some common problems in our work. After summing up these problems, summing up and consulting the anti-malfeasance infringement staff, It is concluded that in the work of anti-malfeasance infringement, problems such as finding the source of the case, collecting evidence, handling the case, and great resistance to handling the case will be encountered, which seriously affect the work of anti-malfeasance infringement. This paper intends to find out the causes of the problem by using the discovery of the problem. The way of thinking to solve the problem is to probe into the problem in the work of anti-malfeasance infringement in order to solve the problems encountered in the work of anti-malfeasance infringement. The first part of the paper mainly summarizes the problems in the work of anti-malfeasance infringement, expounds which problems affect the anti-malfeasance infringement work of the grass-roots procuratorate, the second part will cause the problems in the work of anti-dereliction of duty infringement, from the social recognition, This paper analyzes the particularity of the criminal subject and witness testifying, and points out that there are various reasons for the predicament of anti-malfeasance tort. The last part of this paper is the focus of this paper, which is to establish the integration of investigation. Strengthen the news media supervision and other aspects to solve the problem of anti-malfeasance infringement. This article closely combines the experience of practice in the grass-roots procuratorate, and the experience of legislation and judicial practice is mainly the experience of the predecessor of the procuratorate, the theoretical and practical connection, on the basis of the previous research results, The problems encountered in anti-malfeasance tort are summarized, the common causes of the problems are extracted, and the solutions are found. I hope I can give some suggestions and opinions to the work of anti-malfeasance infringement.
