纠纷的协同治理:国家治理现代化视阈下中国式解纷理念与路径

【摘要】:在推进国家治理体系和治理能力现代化理论背景下,面对当前我国经济社会发展新常态下各种矛盾纠纷凸显的形势,现有的纠纷解决机制存在一些困境,比较突出的问题主要是系统性构建的欠缺,不同纠纷解决方式之间缺乏协同。纠纷具有客观性、破坏性和建设性,要想更好地解决纠纷,应该推动纠纷协同治理,这不仅是对中华传统文化的继承发扬,也是对中国现实国情的契合关照。纠纷协同治理有利于实现效率、公正以及秩序的价值目标,通过充分发挥协同效应、强化纠纷治理过程的动态衔接、注重纠纷治理的系统化构建,能够有效推动纠纷的及时妥善解决。
[Abstract]:Under the background of promoting the national governance system and the modernization of governance ability, facing the current situation of contradictions and disputes under the new normal of economic and social development in our country, there are some difficulties in the existing dispute resolution mechanism. The outstanding problems are the lack of systematic construction and the lack of coordination among different dispute resolution methods. Disputes are objective, destructive and constructive. In order to solve disputes better, we should promote the coordinated management of disputes, which is not only the inheritance and development of Chinese traditional culture, but also the reality of China's national conditions. The cooperative governance of disputes is beneficial to the realization of the value goals of efficiency, justice and order. By giving full play to the synergy effect, the dynamic connection of the process of dispute management is strengthened, and the systematic construction of dispute governance is emphasized. Can effectively promote the timely and proper resolution of disputes.
