交通事故之民事责任的ADR研究

【摘要】：机动车作为现代化的交通工具,带给人们生产、生活高效和便利的同时,也不可避免地带来了交通事故以及因其引发的民事纠纷。ADR作为诉讼之外的纠纷解决方式,以其灵活、便捷、低成本等优点,为纠纷当事人带来了弱对抗性下解决纠纷的人文关怀,也为交通事故中民事纠纷的高效解决提供了重要契机。通过构建ADR来应对日益涌现的交通事故中的民事纠纷将是明智之举。ADR这一概念的提出虽是在近代的美国,然而实践意义上的ADR在我国自古就有,并且形式多样,各有所长,遗憾的是理论和立法没有明确将其整合起来形成机制。我国已经具备发展ADR的法治土壤,在ADR这一概念引入后,学界应当多加关注,结合我国法治现状,对ADR进行客观辩证的考察,尤其是对于诉讼之外,即对交通事故之民事责任ADR的研究,以期早日构建起高效的交通事故民事责任多元化纠纷解决机制。
[Abstract]:As a modern means of transportation, motor vehicles bring people production, life efficiency and convenience, but also inevitably bring traffic accidents and civil disputes caused by them as a means of dispute resolution other than litigation, with its flexibility. The advantages of convenience, low cost and so on, not only bring humanistic care to the parties to the dispute under the weak antagonism, but also provide an important opportunity for the efficient settlement of civil disputes in traffic accidents. It would be wise to construct ADR to deal with civil disputes in traffic accidents. Although the concept of ".ADR" is put forward in modern America, the practical sense of ADR has existed since ancient times in our country, and has various forms and has its own advantages. Unfortunately, theories and legislation do not explicitly integrate them into a mechanism. After the introduction of the concept of ADR, the academic circles should pay more attention to it, combining the current situation of our country's rule of law, to investigate ADR objectively and dialectically, especially outside litigation. That is, the study of ADR of traffic accident civil liability, in order to establish an efficient dispute resolution mechanism of civil liability.
