【摘要】：通过公证赋予符合一定条件的债权文书以强制执行效力是公证机构的一项特殊职能。公证债权文书具有的强制执行效力,使债权人的债权无须经过司法机关的裁判迳可进入执行程序而得以顺利实现,既避免了司法资源的浪费,又提供了当事人各方所寻求的交易安全与法律秩序。因其便捷、经济的优点,赋予强制执行效力的债权文书公证随着我国社会经济的快速发展已经成为越来越多的当事人为保障债权实现而选择的一种法律手段。但由于我国法律法规对赋予强制执行效力的债权文书公证制度的规定过于粗陋,长期以来理论界和实务界、公证机构和法院等相关各方对该项制度的理解存在巨大差异,致使大量公证债权文书在司法实践中的强制执行现状差强人意,未能充分发挥其应有的职能作用。因此,本文立足于我国司法实践,主要运用法理分析和实证分析的方法,对赋予强制执行效力的债权文书公证的法理基础、实践价值、存在问题等方面进行深入阐析,以此探讨完善这一公证制度的路径和方法。本文共计33000余字,除引言外,正文共分为三个部分: 第一部分对赋予强制执行效力的债权文书公证的基本原理进行详细的论述,通过界定概念、分析特征、介绍历史沿革,阐析其法理基础和实践价值。第二部分针对赋予强制执行效力的债权文书公证制度在我国司法实践中存在的若干问题进行剖析,在执行范围、公证核实、执行期限、不可诉性、法院审查和执行异议处理等方面提出笔者的见解。第三部分论述我国赋予强制执行效力的债权文书公证制度的完善建议,提出通过适当扩大赋予强制执行效力债权文书的范围、统一公证机构签发执行证书的标准、减少法院作出不予执行裁定的随意性、完善执行异议制度等途径来完善该公证制度,确保其充分发挥规范民商事经济活动、维护正常法律秩序、保护当事人合法权益的职能作用。
[Abstract]:It is a special function of notarization institution to enforce the creditor's rights through notarization. The compulsory enforcement effect of the notarized creditor's rights document enables the creditor's claims to be realized smoothly without going through the judicial decision, thus avoiding the waste of judicial resources. It also provides the transaction security and legal order sought by the parties. Because of its convenience and economic advantages, the notarization of obligatory documents with the enforcement effect has become a kind of legal means chosen by more and more parties in order to guarantee the realization of creditor's rights with the rapid development of our country's social economy. However, due to the rudimentary stipulation of the legalization system of creditor's rights that gives enforcement effect in our country's laws and regulations, there is a great difference in the understanding of this system between the theoretical and practical circles, notaries and courts for a long time. As a result, a large number of notarized creditor's rights documents in the judicial practice of the enforcement of the situation is unsatisfactory, failed to give full play to its due function. Therefore, based on the judicial practice of our country, this paper mainly uses the methods of legal theory analysis and empirical analysis to analyze deeply the legal basis, practical value, existing problems and so on of notarization of creditor's rights documents that endow the enforcement effect. This paper discusses the ways and methods of perfecting the notarization system. In addition to the introduction, the text is divided into three parts: the first part discusses in detail the basic principles of notarization of creditor's rights documents with enforcement effect, and analyzes the characteristics by defining the concept. This paper introduces the evolution of history and expounds its legal basis and practical value. The second part analyzes some problems existing in the system of notarization of creditor's rights which endows the enforcement effect in the judicial practice of our country, in the execution scope, the notarization verification, the execution time limit, the non-litigability, The author's opinion is put forward in the aspects of court review and execution of dissent. The third part discusses the perfect suggestions of the notarization system of the creditor's rights document which gives the enforcement effect in our country, and puts forward that the standard of issuing the execution certificate by the notary authority should be unified by expanding the scope of the creditor's rights document with the enforcement effect appropriately. Reducing the arbitrariness of the court's decision not to execute, perfecting the system of execution of dissent, and so on, to perfect the notarization system, to ensure its full play in regulating civil and commercial economic activities, and to maintain the normal legal order, The function of protecting the legitimate rights and interests of the parties concerned.
